    Can anyone help or give me further advice.

    Requested my statements from Halifax originally on 1st March 2007, after 40 days - no show. I rang the head office number and the lady I spoke to said there was no record of my having requested them (my cheque had NOT been cashed) but she could order them for me over the 'phone and deduct £5.00 from my account. This I did and received the statements about 3 days later. Calculated all my charges and sent off the first letter. After 4 days I got standard 'Thank you for contacting us with your complaint............ we will investigate and get back asap'. Four weeks later got another letter saying 'we have been unable to complete the investigation into your complaint and will contact you asap certainly no later than 20th June 2007'. Suprise, suprise today I received the ' charges are fair, terms and conditions blah blah blah' letter. I rang the O845 number and spoke to a very (seemingly) understanding man who said he will revaluate my case and get back to me asap, I (rightly or wrongly, I don't know) replied that I would prefer the reply by the end of the week as I had waited the eight week period and total time since asking for statements was over 16 weeks. He said that the evaluation would be done quicker because he was onto it straight away and promised me a reply by Friday. He even said not to do anything hasty (ie fill in and send off court forms) if nothing had come in the post by Friday but to give him a call back first. My original claim is for £1800, I have not claimed interest or anything else additional.
    Does anybody have any advice? Do you think I will get offer by Friday or is this simply another time-wasitng tactic?
    Any thoughts welcome!!

    Went through same sort of scenario and had an offer within a week just a matter of
    a) accepting or
    b) rejecting good luck :D

    Thanks for that - a little bit of good news then I think! Just a matter of waiting (again!!) until the end of the week. Fingers crossed!!!!

    Just phoned Halifax in regards to money put account and it has been put in by customer relations department, have to wait till 9.00am to talk to them as money well below what was asked for. Roll on 9.00am get myself ready for a spot of haggling and growling if that is what it takes :)

    Hi can anyone help? I send Halifax all the letters and after waiting 8 weeks(couldn't afford the court fee again!) i recieved the standard our charges are fair blah blah letter. I then called Halifax to request my claim be re evaluated! I was told this again will be up to 8 weeks. We are now in our 7th week and still nothing. I sent a claim form to the financial ombudsman last week as i am sick of waiting. Has anyone had any dealings with them? Are they helpful? It it more sucessful than going to court or should i file on MCOL? Help Please Thanks Cally
  • hmm, recieved my fob off letter, now on the phone to halifax...0845 number though, been "in a que" for 5 mins now...they must be making quite a bit from this...
    i think im in the wrong industry...

    They responded by declining my claim, and I then sent a letter about taking them to court, (but offered a reduced settlement) giving them 14 days to reply.
    I have now been told by the bank that they legally have 8 weeks to respond to this letter. But after reading this site I thought they only had 8 weeks from the 1st letter (the claim letter).

    They also tried to fob me off by saying I probably won't get my money, nut I know that's a tactic to scare me off and I ain't falling for that!!

    Can anyone advise if the bank is correct in what they say, do I have to wait another 8 weeks or can I proceed to court NOW?

    This seems like it's been going on forever, and there seems to be no light at the end of the tunnell?

    It’s SOB (Standard Operational B*llsh*t).

    The Information Commissioner gives everybody 8 weeks to reply to a Subject Access Request, and will not accept a complaint before this.

    The Financial Services Agency gives them a maximum of 8 weeks in which to reply to a customer complaint, and the Financial Ombudsman will not accept a complaint before this, if they do not reply. (However, if the reply either suggests that you now refer your claim to the Financial Ombudsman or says a definite no, then you can refer your claim to the Financial Ombudsman straight away.)

    You can give them as long as you like before you take them to court. We use 14 days because this is the usual timescale that the courts give solicitors to reply, etc.

    By giving them less than 8 weeks, you could say that we are doing them a favour by trying to make sure that they meet the FSA deadline.

    As you have not received an acceptable reply by this deadline, then start court proceedings on Money Claim Online.

    PS. There is light at the end of the tunnel: unfortunately, its probably someone with a torch and an Allocation Questionnaire!

    I'm in same position, thing is I'm getting married shortly and dont have the £100 to put on MCOL until after the wedding at least (it's my new hole in the pocket) I'm on week 4 though, and i've rung 0845 twice and today 01977.. number and told will here in next few weeks.

    I've been waiting since the 31st May on my revaluation and i have just phoned the 'Very Nice Man' on the 01977 number. He was querying how so many people had got his direct line number !!! He says his phone has rang non stop today and that the majority of calls were not on his case list.

    Anyway he said he'll review my case today/first thing in the morning and get a offer let out to me !! Progress is being made finally !!!
