    Yes i've thought this, although im claiming against Lloyds at the moment its just the same. Some people receive gestures of goodwill others dont. Some are setted in full as a defence is submitted some receive no defence, pretty hard to get your head round !!! :rolleyes:

    I'd be ready to go to court, the likely outcome is they will make an offer once you file the MCOL, usually for charges but not interest or the MCOL fee. I tried to negotiate with my bank Nastywest but they refused, I said oh well lets go to court! The jargon you may get from the courts is confusing but plenty people on here have been through it already & are more than willing to help :beer:

    I too was at this stage they had a week left to put in a defence but as other people have just had their money put in their accounts without no contact I thought I'd check mine and this afternoon its all in there. I still can't believe it. Please everyone stick at it.

    Where oh where can my statements be? oh where oh where can they beeeeee?

    After three requests for statements to be sent (theres only 6 months worth showing online?!?) im still no further forward.... and Im sure Halifax owe me more than other companies do!

    Any one else had a problem even getting started with their Halifax claims?

    HSBC £2518.68 1st Letter 15/05/07, Acknowledged 23/05/07, LBA sent 06/06/07
    Capital One £1112 Request letter sent, 11/06/07 offer of 348 received, "ill have a part payment pls along with the rest" leter sent
    Black Horse £25 supposedly?! - i think not! show me evidence!
    Halifax lBA sent 20/06, Rejection letter 22/06, Phoned for Reevaluation 25/06 ..the waiting starts
  • My girlfriend is currently trying to reclaim her bank charges, unfortunately Halifax are not co-operating.

    We sent the original letter, then got a reply 7 weeks later declining her claim. We then sent a letter 13 days ago stating that we were going to court. We offered a reduced payment settlement but we have still not had a reply!!

    When phoning Halifax we told them that they had been sent a letter to this effect, they disagreed saying they never got it. Luckily we sent via recorded delivery, so we proved that they did get it.
    Then they had the cheek to say that they had another 8 weeks to respond!!!!

    They were then told by my girlfriend that this was WRONG, and she told them the Financial Ombudsman had said we were entitled to demand a 14 day turnaround.

    Now we are trying to chase up progress and we are put on hold for ever, and as we are phoning from a mobile we are using all our credit (£10 every time) and are not getting to speak to anyone.

    Tomorrow is the 14th day of the demand, so due we then go to court to make a claim???

    how de we go about that, and what form do we fill in?

    Friends of mine have been paid out no problem, it seems we are not having much luck with our Claim!!

    We just want an end to this nightmare!!!

    I would advise looking at the halifax thread. most people on recieving the decline letter have phoned and asked for a re-evaluation and then gone from there. If you go through the halifax thread you will get a rough idea of halifaxs methods and how to deal with them. it is a long thread but I found it fantastic help to get a successful claim.

    Your first claim letter should give them 14 days to reply. If you have not received an acceptable reply by your deadline, send them the second “Letter Before Action” letter. At this point, you have to decide between referring your claim to the Financial Ombudsman or starting court proceedings.

    If you don't think that you could successfully handle a court claim, or can't afford the court fees and aren't eligible for fee relief, then the Financial Ombudsman is an alternative. It is free of charge and handles everything for you. However, they cannot force the bank to pay up, set the level of the settlement or award interest like a court. Despite this, their success rate is good. Being financial experts, they can also threaten to ask the bank some very awkward questions. If the Financial Ombudsman is unsuccessful, you can still take the bank to court.

    If you threaten to refer your claim to the Financial Ombudsman, give them until 8 weeks from the date of your first letter to reply. However, if the reply either suggests that you now refer your claim to the Financial Ombudsman or says a definite no, then you can refer your claim to the Financial Ombudsman straight away. If you have not received any reply for the 8 weeks, then you can refer your claim to the Financial Ombudsman.

    If you threaten to start court proceedings, give them 14 days to reply. If you have not received an acceptable reply by this deadline, then start court proceedings on Money Claim Online.<O:p</O:p

    Started way back in Feb.
    No joy whatsoever, stuck to the timescales, went through MCOL - no acknowledgement - no defence - judgement by default:beer: well nearly, sent them a letter giving 10 days to pay up or billy the bailiff would be calling. Nothing- 10 days up gave a courtesy call to see if anything could be sorted- passed from pillar to post for 90 minutes then the phone was put down on me- charming. Rang them again today to complain about my treatment yesterday- phone put down on me again after another 40 minutes(big time Victor Meldrew moment):mad:
    Sod that, courtesy out of the window pressed the warrant on MCOL site(another £55 they now owe me)
    Hopefully that will wake them up, although i would not mind assisting the bailiffs when they arrive at my local high st branch

    just looked in one of my accounts and £!,880 has appeared as a cash entry online??? This is strange as I have a £4,000 claim is this the part payment and then start to haggle?? anyone else had this. Still have another account which is owed £922 but nothing in this account.
    Anyone help please
