Hi anyone help!!, now claiming for my daughter can she claim the charges fro m feb01-june 06 as she has not had any charges before or since, and with it now being june do you have to go from june01-june06. Dont want to make any mistakes!!0

well, success for me. I rang up 01912357810 and asked to speak to the person in charge of my claim (name will be on your letter) i was polite and bascially said that i wasnt happy with my offer of 50%, and that i was actually in the middle of filling out my claim online, and i was offering them a chance to give me 75% of my claim otherwise i would commence the court procedings. If i was to receive the amount i wanted i would close the case there and then.
The lady i spoke to was really nice, and said that they would offer me 75% and that it would be in my account within 5 days. woo hoo!0 -

Well, I've just received my statements, having requested them for the last 6 years from the Halifax and the ones they sent me started in January 2001, up until May 2007.
So you should be ok if you just ask for your daughter's statements/charges for the last 6 years.

Thanks Dan we have the statements but was not sure if you have to go from june 01 to june 060 -
paid fee for statemtns on may 3rd, sent reminder on 30th may , received statements today on the 8th June.
now requesting payment of charges + Interest

I am new to posting and have started today.
I have been following Martins steps to reclaiming my bank charges which total around 2,000.
I have used the MCOL and they have written to me two weeks later to state that the Halifax will be defending all of my claim.
I am not concerned that this will go to court but I am concerned that I won't have the right preparation in place (due to the recent lost case).
Can anyone help with this or can anyone tell me if they have experienced this with the Halifax?
Any info will be greatfully received.

Whilst taking a bank to court is not something to be entered into lightly, you have a right to justice. The bank also has a right to defend your claim against them, but the legal jargon their solicitors will use is designed to intimidate you into giving up.
The bank’s solicitors won’t turn up. They daren’t. The last thing they want is to have to answer some potentially very expensive questions, such as just how little it does cost them to administer a late payment, overdraft, etc. However, this doesn’t mean that you “win” automatically. You still have to prove to the judge that you are due your charges back.
The next step is to start getting your court bundle up together. This is basically three copies of everything you already have: your list of charges, your letters to the bank and any letters from the bank. Depending on the actual defence, you will need some other more legal documents.

I sent the first letter in April requesting my statements, heard nothing for a month so phoned up, got the statements within three days. added up all the charges, sent the letter off to claim them back, got a letter back within a week saying charges are fair, no refund etc, phoned them that day to say I wasnt happy with that, they said they would pass it on to a senior person to look at again. That was about two weeks ago I think. Just happened to find out today via telephone banking that £429 had been put in to my account (hadnt received a letter to tell me that), spoke to an adviser, they gave me the number of the customer relations manager who had dealt with it. I took a deep breath, phoned him up, had a very decent converstation in which I said that basically I wasnt happy with the amount and that I wanted the full amount,he said Ok, without the interest and I said fine, that will do. He was actually a lovely bloke who listened very carefully to what I was saying so I was very happy with that and EXTREMELY relieved that it was so easy to do!! I did take the tack right from the outset of being reasonable about it, polite and good humoured. I hate haggling, am rubbish at it actually so it was a huge relief to me that we just had a decent conversation, he just offered me 100 percent no messing about and listened while I rambled on about how much the banks had taken off me over the years and the mess I had got into with them! At one point I actually said to him I dont know why I am going on when you have already offered me the full amount, he just politely said that he wanted me to have my say! Nice bloke! I am absolutely convinced that it is all a game, they knock you back without even looking properly at the claim, its almost like a dare to ring them back, then when you do they offer the 50 percent, again, to see if you fight back then if you do I reckon its really who you get on the day and the way you handle it that counts. Steps in a dance, isnt that the way Martin describes it? He is bob on with that analogy I reckon.
I can't believe I have actually got this back and I am immensely grateful to this site (and Martin especially) for giving me the confidence to do it. I have been reading success stories on here for weeks now and couldnt imagine that I might be one of them. I wish everyone going through this the very best of luck. It all feels a lot like a lottery to me but I realise now it really does pay to keep going with it. when I got the knock back letter I felt really demoralised but I just thought grit your teeth and get on with it- we shall overcome!!!
I have another claim with RBS outstanding for £4200 so this has really boosted my confidence today. After them I will be going after cooperative, egg and alliance and leicester credit cards.

I am definitely not taking going to court lightly. I just won't be intimidated by them. I have a feeling this will go all the way and the information you have just provided is great. It is the court side of stuff that I am not yet fully aware of.0
