    Yes this has happened to me. Was on here last night writing posts about it and today we received a letter saying they are paying up all the charges, interest and court costs!! Result!!

    They had acknowledged the claim and had one week left to enter their defence.

    Off to post my success story!!

  • Just a time update on statements, After 40 days and 2weeks, a fobbing of letter, on how they fell my charges are within reason and a phone call to customer relations. I recieve a battered large white envelope with statements going back to May2001. ( to days date :9/june2007).
    Now i have to add up all my charges and interest. Do i ask for all the money or do i subtract the suggested £12 that should have been charged for each default?

    Ask for all the money. The amount to send letters out, bounce cheques and take you overdrawn is meant to be more like £3 tops so dont give them anything unless they suggest an amount to cover the charges!!!

    hi guys

    got an offer this morning of £171.50 out of a claim for £370 (although i had added interest they had debited of £43) i rang up again and the woman on the phone basically said that there has been no evidence to suggest that their charges only really cost £3 and that my offer is an offer of goodwill&that they will not go higher.
    I threatened with the Ombudsman etc and she said thats fair enough but not to say i will get it back.
    Im a student and skint, lol. So i dont know whether to accept the offer or wait it out with MCOL? how long do you think it will take, as they are saying that my account will be debited with the money within 14days.

    Please any advice will be great

    Hi guys,

    10 weeks after my initial letter demanding bank charges, I have a mini result.

    I claimed for approx £7000 (Including interest). £5500 without the interest being applied.

    A couple of weeks ago I received a letter stating the charges had been applied as per the terms and conditions...I of course called them and they escalated the demand.

    I gave them 14 days to respond and when no response was received yesterday, I called the 0191 number and spoke to someone who said I would receive a response today.

    This morning, I received a letter offering £2800 which I suppose I am happy with. However it's way short of the £5500 applied to my account over the past few years.

    I think I should go back and negotiatiate closer to £5000.

    Can anyone offer some advice on this?? Thanks

The bank has not acknowledge any of my letters and considering the problems I have had just to gain the list of charges I am unsure what is the best way to proceed

    Hi, Everyone,

    Got a Notice this morning from Northmpton County Court that Halifax had received the Acknowedgment Of Service that was filed last week on Thursday 7th June '07.

    They now have 28 days from that date (until around Wed 4th July) to defend themselves.

    Any more ideas (besides Martin's) for next action to take would be welcome.

    hi just follow the template letters in order m8. if you have already sent letter 2 giving them 14 days to respond, then the next one is the LBA (letter before Action) then finally go to MCOL. they never responded to any of mine either and took ages to get statements to me. i filed via mcol and they acknowledged and they've got till next sat to file a defence....knowing my luck they will lol
    halifax bank claimed £4803 (£5863.88 inc%) paid £6143.29 :j
    CapitalOne card claiming £478 (£609.18 inc%) paid £689.71 :j
    Citicards claiming £700 (£888.23 inc%)

    halifax bank (account 2) claiming £543.15 (£564.09 inc%) put on hold due to OFT outcome

    Hi there,

    As the previous poster stated. Just follow the steps as per Martins instructions and you should be laughing all the way to the bank so to speak.

    It has taken 10 weeks from the intial letter reclaiming my charges for me. Just received an offer from Halifax but only 50% of what I am due so going to call them on Monday to negotiate me thinks
