dezzi, I received the standard rejection letter on the 6th June. I phoned them straight away on the number at the top of the letter (think it was 0845 124 1330). Basically was as polite as possible and the first thing I did was say "I've got a reference number from a letter here, can I give you that just now". Once she'd confirmed some details to prove it was me she asked how she could help. I explained that I'd received a rejection letter regarding my claim and explained that I felt since the letter was dated the the day after I sent my letter that they couldn't have considered my claim and asked if it could be reassessed properly this time. The girl apologised and said she'd put it forward to be reconsidered and said that she needs to make me aware that this can take up to eight weeks from the date that they first received my letter but hopefully they'd get back to me before that.

I plan to phone back to check the progress though. I think the key is to be polite and pleasant and they'll be far more willing to help you.

*EDIT* Meatloaf - I would suggest that you phone the bank and without giving them any details about yourself in the first instance explain that you've received a letter from a debt collection firm claiming to be about an account from them. Tell them that you think it's actually an account that you closed a couple of years ago but you can't be sure because you no longer have the account number and sort code etc. Ask them nicely if they are able to give you this information if you provide them with your address etc. that would of been registered against that account. Chances are they'll try and help you. Then phone back with all the details and explain the situation and demand to know why you were told the account couldn't be found in the first place. I think it always pays to be a little bit sly.

This has worked for me in the past when I've had a warranty claim on a car. I was trying to claim on something that I knew I'd been told was covered but the garage claimed wasn't. I sent my girlfriend at the time to go car shopping and ask details about the warranty. Specifically whether the thing I was disputing was covered. Once they told her it was I appeared and kicked up all kinds of hell :D Arnold Clark 0 - Me 1.

    Hi

Can anyone help? I am at the Court stage using MCOL, it was served to the Halifax on the 16th May 2007, then acknowledged on the 21st May 07 saying they plan to defend it. If I am correct, they have until Wed 13th June (28 days from when it was served) to issue their defence. I have not heard anything from them and they have not paid back anything. If they do not defend and they have not paid me my money back, do I just enter a judgment via MCOL on wed 13th June? Has anyone done this and if so how long did it take for them to pay up? Any information on this would be greatly appreciated. thank you
  • GAZZBLUE : How long was it between asking them to reassess your case to getting your offer on the 9th June ?

    (for the third time)

    Hi,

I'm doing 2 separate claims through 2 accounts with Halifax, sent off both letters at the same (inc Interest) one coming to £1036 and the other is about £500, I had a letter back declining the re-charge for the £500 after about 3-4 days, but I haven't had anything from the larger amount yet, and it will be 4 weeks on Friday...what do you suggest I do? ring up? send the letter again or send the next letter about court action? (I am sending ALL my letters special delivery so I know it's getting to them, it may cost £4 but it's worth it)

    Cheers.

skins - I assume the letter you sent about the larger amount had a 2 week time limit on it. I would phone the number on the letter you got back for the smaller amount and tell them that you still haven't received a reply regarding the larger amount although both letters were sent at the same time. Ask what's happening for that one since you requested a reply in 2 weeks. If they claim not to have received it then resend it with a note saying this is the second time you've sent the request therefore this time you expect a reply within 7 days or you'll take court action. See what happens.

OK guys, another update for you.

Original Claim of £5500 without interest, 10 weeks, 3 letters and numerous calls later, got an offer of £2800 on Saturday.

Called them today and negotiated £4500......

Should I stick to this or go for the full amount?

GO FOR THE FULL AMOUNT, IT'S A GRAND!! OF YOUR HARD EARNED CASH THAT THEY TOOK AWAY FROM YOU UNLAWFULLY!. THE THING IS YOU HAVEN'T TAKEN IT TO COURT LIKE I HAVE SO YOU WOULD HAVE TO PAY THE £120 FEE BUT YOU WOULD GET THAT BACK ON TOP, IT CAN BE A SLOW PROCESS IF THAY ACKNOLEDGE YOUR CLAIM, IF YOU ARE HAPPY WITH 45OO AND THAT WILL GET YOU OUT OF DEBT OR HELP WITH OTHER THINGS THEN ACCEPT IT, I HAVE HAD £200 WORTH OF BANK CHARGES THIS MONTH AND I'M CLAIMING FOR THEM AS WELL!!! GOOD LUCK LET ME KNOW HOW YOU GET ON X

    Hi Katdora,
I am in the same boat as you. I entered my judgement yesterday as the Halifax didn't respond within the 28 days, my claim has to e double checked by the corts before they issue it to the Halifax but when you fill out the judgement form after the 28 days it asks you how you want to be paid and i ticked the immediately box so i'm hoping they issue the bank with a warrant for the money, i'll keep you posted on my progress so you can know what to expect.
  • sent first letter got rejected, sent second letter NOTHING so I phoned them today and a very nice lady said that they were looking into it and have up to 8 weeks to do so. she also said that these charges are lawful!! eh? is that a lie? surely they are not allowed to lie? has anyone else come to this stage of... looking into it and have 8 weeks to get in contact? Thanks
