    HI EVERYONE,
    i AM CURRENTLY AT THE COURT STAGE PROCESS, HALIFAX DID ACKNOWLEDGE MY CLAIM WITHIN 14 DAYS WHICH BASICALLY JUST BUYS THWM ANOTHER 28 DAYS, THAT WAS UP TODAY SO I FILED FOR JUDGEMENT AND IT HAS BEEN ACCEPTED, ON THE FORM I ASKED FOR PAYMENT IMMEADIATLEY AND THE COURT HAS TO LOOK AT IT BEFORE SENDING IT TO THEM, DOES ANYONE KNOW WHAT I DO NOW? DOES THE COURT ASK THEM TO PAY UP? OR WILL THE HALIFAX HAVE TO GET IN TOUCH, HAVEN'T SEEN ANY THREADS ON THE FORUM WITH THIS ON, OR WILL THE BANK JUST SETTLE? PLEASE HELP, CHEERS GUYS AND TO MARTIN!!

    I THINK IT DEPENDS ON YOUR OWN PERSONAL SITUATION, LIKE MARTIN SAYS IF THEY OFFER YOU AN AMOUNT THAT WILL MAKE YOU DEBT FREE THEN ACCEPT IT, IF I WAS YOU THOUGH I'D GO FOR THE FULL AMONT, THAT'S YOUR MONEY AND YOU SHOULD BE ENTITLED TO IT ALL, IF EVERYONE STARTS ACCEPTING A FEW HUNDERD QUID LESS THE BANKS WILL BE WINNNING AGAIN AND WE DON'T WANT THAT. STICK TO IT AND CLAIM THE LOT! GOOD LUCK MATEY!

    I have recievied my charges back £3499.00 claim was for £4364.07, but no matter how much I also pressed for the interest they wouldnt budge , I told the Lady on the phone I would complain to the FO about the interest to which she replied that I was entitled to do. I have been sent the forms by the FO to fill in about my complaint about getting the interest back.
    Anybody else had to do this or is it a waste of time ? :confused:

    OK guys, another update for you.

    Original Claim of £5500 without interest, 10 weeks, 3 letters and numerous calls later, got an offer of £2800 on Saturday.

    Called them today and negotiated £4500......

    Should I stick to this or go for the full amount? :confused:

    I have just totaled up the amount of charges halifax has taken out of my bank account.£3443.77 includfing percentage. I didn`t think it was this much.
    So do i send the demand for refund letter to the branch i belong to , or is it better to send it to the head officeTrinity Road Halifax ? Which one has got the better response in your opinion?

    Hiya, I sent 2 letters to Trinity Road. The first one they answered straight away so I sent the second. With this one they didn't reply within the 2 week deadline I specified so I've just filled in my moneyclaim online.
  • Ive been trying to claim back £1,971 ....id sent all the letters off, i recieveed the "8 week to investigte" letter. Then i recieved rejection letter.
    Then i phoned the 01977627450 number and the feller said he will look into the case agian.
    On saturday 9 june recieved a £980 offer so I phoned again today (number 01912357810). I said i wasnt happy with the offer ,an hour later she phoned me back with an offer of £1,600 which i have exepted.

    The two phone numbers that i have mentioned have been VERY helpfull. So i want to say a big thank you to all who've posted on this site.

    I've been lazy about registering so this is my first post. All this info has been very helpful so thanks to everyone who's been involved in all this.

    GAZZBLUE : How long was it between asking them to reassess your case to getting your offer on the 9th June ?

    I sent my letter dated the 4th June requesting my charges be refunded. I thought I'd try a slightly different approach though. I requested that ALL my charges over the past 6 years be refunded and went on to say that the statements which I have access to online only detail the past 2 years during which I've paid £1334 in charges. I went on to ask that they let me know how much I've paid in 6 years and said that I expected an offer to settle my complaint taking into account all 6 years charges.

    On the 6th June I received the standard rejection letter dated the 5th June but no information on what my charges had actually been. I called the number on the letter and explained that I wanted my claim reassessed. I also told them that in my opinion my claim had NOT actually been assessed and I'd just been automatically rejected pointing out that the information I'd requested about the past 6 years had NOT been given. I asked the girl on the phone if she could give me this information and she apologised and said that she would send my 6 years of statements which would be with me in 7 days.

    I plan to call back once these statements arrive and I've calculated all my charges and tell them that since they haven't calculated my charges as I requested that I've done it myself and give them the final amount for my claim.

    I'll let you know how I got on. If it works then it seems a quicker way of receiving your statements than doing a FOI request.

    *EDIT* I meant to say that at the top of the letter I added the phrase "WITHOUT PREJUDICE" since I believe that this means they can't hold me to my 2 year claim of £1334 and I am then able to give them further details. Don't know if this makes any difference or not.
  • I wrote to Halifax for my wife on 18th March to get the information on charges from her plan with IF.

    We got a letter back last week stating because we did not provide an account number or roll number they can not trace the account to provide the information :confused: , even though we supplied my wifes full name, address for last 6 years and date of birth. The account was closed 2 years ago.

    Can they do this or do i have to go through a court/ICO to get the info?

    Any help is greatfully recevied.
