    Ok I've done it, don't know why the thought of what lies ahead scares me, but it does! which is why I've looked and lurked around these boards for so long before taking the plunge. My £10 & first letter went off by recorded delivery to Halifax today so here's hoping for a smooth run.

  • Recently received an offer from FDirect but in the same post received a letter from Halifax stating that i have no claim and have not been mis charged, they mention that in their terms and conditions you must have enough money in your account to avoid going overdrawn.
    I have checked through my statements and worked out that they have charged me over £800 in charges over the past few years. Could someone advise if this is correct. The letter received just seemed to be a standard letter with a photocopy signature and this was sent from Head Office.
    Like you I have just received an offer from FD which is for the total amount i paid in charges .:: The Halifax rejected my first letter but when iwrote a second they tried to phone me and discuss the account , i asked them to put what they wanted to say in a lett er which was an offer of about 60% of my charges (600pds) , i have rejected this and am waiting for another letter which hopefully will be a better offer: I have read on otherr forums this is standard pratice for the Halifax, keep plugging away and they will make you an offer

    You can only claim for six years back from now so if the account has been closed say 2 years that would be 4 years you can claim.

    Bank number TWO.......

    First tust.I clused it four four years ago.and and I have requested a list of fees during its operation........but they will only supply FULL statements and not individua charges.they are demanding £560 for these at 56 sheets at £10 THEY WILL NOT ISSUE FOR A one PAYMENT AS SUGGESTED ON SITE OF £10.....

    I woulddlook forward to any advicethatcan be given in order that I may claim over £20000 from various banking institutions.

    Same with the second bank you would only be able to claim back two years.

  • ADVISE PLEASE.......not sure what to do next my charges came to just over 6 thousand i know i cant use small claims court so do you think that i should offer them a reduction to 5 thousand in my second letter......so that if they refuse i can still use small claims court......getting worried now......arghhhhh

    You've got a couple of choices. You can still issue a court claim for £6000, but it may be dealt with through a different track in court from small claims. You should still win your case (many others have), but it can be a little bit more work involved for you.

    You could also split your claim at the court. Issue two claims keeping each claim under the £5000 limit (i.e......claim 2001-2003 for £3500, and 2003-2006 for 2500). You would need to work out the best date to split your claim to keep under the limit.

    Don't lower your claim to the bank because of this.

    submitted my claim via MCOL site on 28/12/06, claim submitted to Halifax on 29/12/06, served date deemed to be 3/01/07....

    claiming £1800 charges plus £120 court costs.

    guess what, i got a letter from Halifax customer relations dated 3/1/07 (same as "served date") offering a "goodwill gesture" of £900.00 in full & final settlement. the letter also had a form for me to sign and return if i wanted to accept the £900.00 which included a sentence confirming i agree that halifax can close my account if i don't operate it correctly.

    oh well, halifax have until 17/1/07 to reply to my claim via the courts.
  • thanks rex i think the latter is a good option....would i have to pay two lots of court costs if i did that and what court to i say in letter two there time is up on monday and tht i would get letter prepared but not sure where to mention. Is it my local court even if i use the one suggested on here?? If i pull this off i'll buy ya a drink mate....god its so nerve racking

    Yes, you would have to pay two lots of court fees for two claims, but these are added to your claim anyway so you would get your money back.

    Seems to of you have received letters yesterday from the Halifax and I haven't heard anything. I also sent mine recorded delivery on tuesday to my local branch

    fingers crossed for the post this morning..
