Just rang my branch.
Here goes.
Spoke to the branch who informed me I didn't have to send direct to the branch and normal procedures is : Send direct to trinity road... Anyway he has actioned this and I should hear something hopefully by next week. Quiet a pleasant young man as well... At least that's the 1st stage over with.
second part
I rang for copy of 2003 statements two weeks ago received them on tuesday and had to pay nothing. When I rang last weekend to see if it was going through 08457 20 30 40 number, the guy I spoke to said "I had to pay £5.00". Oh well I thought no worries as long as I get them all". yesterday morning the postman had to knock my door as he had 42 envelopes of the last 5 years bank statements.
Now where's the sense in that ... Didn't bother to open them all as I had already done my homework on Tuesday... Ummmmm so annoying isn't it ???:A Tomorrow's just another day - keep smiling0 -
Hey all just come across this forum and thought I would post my views. As everyone else I always thought that £30 for being a few quid or pence over your overdraft was a little bit much but did honeslty think that this was a fine that they put in place for not sticking to the agreement.
Im not sure what I have totalled over the last 6 years but I do no it will be quite a bit. A friend of mine has given me a letter to send when you have worked out what you are owed but what I want to no is what are the very first steps that you have to take? Which would be the best way to go about it?
Should I phone the bank and request statements???
Or write to them???
and if i was to write does anyone have a template letter which they could post for me??

Hi, Just wondered if anyone could offer me any help. I have written to the Halifax with regard to charges. The first reply I got said they couldn't help me and that they weren't unlawful. I wrote again on the 23rd of December giving them 14 days in which to reply before I take them to court. Yesterday I recieved a letter saying my complaint was now being handled by the customer relations department who would be in touch shortly. The trouble is do I hang around waiting for them to get in touch or do I go ahead as the 14 days are now up? What would you do?
My Oh is also claiming charges. He has just recieved his 1st reply stating that it was being handled by the Customer Relations department too but no time limit on them getting back was stated. Should he send them another letter saying if he doesn't get an adequate reply in 7-14 days he'll take them to court?
I think they are just hoping we'll give up and go away but both our claims add up to just over £1500.

Keep to your timetable, not theirs. You are giving them enough time to deal with your claim.How many surrealists does it take to change a lightbulb?

OMG! I've done it! I've taken the Halifax to court. I've paid my £50.00 fees and set a reminder on my phone for 19 days. So if I haven't heard anything by the 25th, I'll move on to the next step. My Oh has also sent them a letter giving them 7 days to settle or he will start court proceedings.

Firstly let me thank Martin and everyone on here for all your help and guidance in the bank charges row. I am becoming such an expert! I am personally taking LloydsTSB to court but i am writing today with regards my parents charged form Halifax.
I am doing all the leg work for them on this one! I sent the first letter and kept getting a "we will write back shortly" letter. So on the 27th Dec i sent letter 2 giving them 7 days to sort it. On the 4th Jan they got back offering £336 of the £564 + interest i am trying to claim.
Obviously i want to reject this but has anyone else done this? whats the best way to word the letter as I'm struggling a little bit. Also are they likely to come back with the full amount or see them in court?

First of all. Seeing as they have not answered your letters in a satisfactory way. Start your court cliam.
Re the offer.................
You don't have to answer this if you don't want to. They will receive the court papers very soon if you issue a claim in court. If you want to reply, you can use something like this...........
Regarding your offer dated (insert date). I cannot accept this offer of £336 as full and final settlement of my claim. I would accept this as a part payment and without prejudice. For a company of your size and standing, I have allowed ample time for us to settle this matter between us. You have not replied to any of my letters in a satisfactory way, so I have issued a claim in the county court for the charges plus interest plus court fee. I am now prepared to let a judge decide upon the lawfulness of these charges.How many surrealists does it take to change a lightbulb?

I have worded a letter giving them a further 7 days (perhaps foolishly but going on advice from a friend who rejected the offer and then got the full amount).
I have also saved 30p by sending my letter back in the SAE they enclosed which was meant to be for the signed agreement0 -
hi all,
Sent my local branch one of martin's letters just before Christmas, they replied saying they have sent it on to head office.
The charges were for £801 then this morning they rang and asked if i had started court proceedings i said no ,and they offered me £600,which ive decided to accept. I then went down to my local branch and complained about my last bank charge of £30 and the refunded that as well result.0
