When they said my case would be re-evaluated, (They received the LBA letter at the same time); I made a pain of myself & rang them alot! On the 14th day they settled for nearly the full amount....today they settled on the last remaining a/c (loans) for the full amount; I am one happy bunny....since I got all the statements it's been 5 weeks!!!!:money:  :j :j  :money:

    Evening folks,

It's heartening to see that like myself, plenty of people are getting the standard rejection letter and have since gone on to be refunded. I received the letter on 21st of May and, following the advice on here, called them to say that I don’t accept their decision. They agreed to re-evaluate the case and advised they would get back to me ASAP. 2 weeks later iv heard nothing, called them today only to be told their is no time frame and they wont commit to anything.

my question is, how long have people generally waited to hear back from them at this stage with hopefully, an offer? Or, what can I do to speed up the process. Already threatened them with court but they basically said its up to me if I choose this option. Problem is, I can’t afford the court fees right now so this was an empty threat.

Any advice would be most welcome.

    Cheers folks

Halifax are bound by FSA complaint procedures to
    a) issuing an acknowledgement of a complaint within 5 business days of receipt
    b) to then issue a substantive response to the complaint within 4 weeks of receipt OR, if they cannot do that, send you a letter explaining why
    c) they then have a further 4 weeks from then (so a total of 8 weeks from receiving the complaint) to issue a response OR tooffer you rights to refer tothe Financial Ombudsman.

I have a claim (pp myfather) ongoing for £5995 plus interest. Halifax received it in mid April and acknowledged it. I have now received their initial rejection of the claim and I have phoned to reject their findings and asked for a review.

Halifax have until 14 June (ie 8 weeks from when they received the original complaint) to issue their response. They do NOT have a 8 weeks from the date I asked for the case to be reviewed. If they cannot respond to me in the 8 week timescale they must offer me rights to go to FOS. -

    Hope that helps....

I'm not yet going down the MCL route - will wait and see what their approach is following review.

To date I've succeeded as follows on behalf of my father - so keep going and don't be disheartended!

Lloyds TSB Credit Card - £186.86
    MBNA Credit card - £530.00
    GE Money-secured loan - £430.00
Total money reclaimed -£1,143.86: :rotfl: :T

Am also waiting for charges on Halifax Credit Card to come through and will ask for refunds on that too....then on tonationwide pp my step-daughter....

  • Since learning about the re-evaluation thingy with the Halifax, I've tried it on with Nationwide. Don't know if it'll work, but wont take long to find out as I gave them 14 days to reply. If they don't play ball then I be using the MCOL that I've completed but just haven't submitted yet! Anyone else used it with any other banks?
