  • I sent the first letter in and got a machine written rejection letter within 7 days saying that if they, (HBOS) did not hear back from me within 30 days then they will assume that I accept the rejection.

    10 days ago I wrote the second letter the next day threatening them with court action, so far they have not responded.

    Thanks NHolmes. Mine was exactly like that. I am sending a letter first class recorded today. Is this what they generally do? I have tried looking though this forum but its HUGE!!! I havent got a big big claim but still. How much are u claiming? I dont really want to go to court and lose but im not giving up, Ill go just a bit scared to be honest...

  • where it says on a bank statement "Interest Debited- notified last month" can i claim this too. Im gettin married in sept and want to try and get this all out of the way. Thanks sonya

    I doubt it sonyac as this is the interest on your overdraft that you have agreed to. Check the thread entitled 'reclaim bank chrages help' as they have a list there for you!

    Ive gone through MCOL, and am waiting for Halifax to make their next move. Was hoping to phone them today and get this sorted once and for all. What is the telephone people ar eusing to contact them please?

  • Hi all, first time poster, I'm sure this has been asked many times before so appoligies in advance but just after an answer to this question please.

    I have issued a claim via MoneyClaim which was deemed to be served on the 21st of May, it states the defendant has until the 4th of June to reply (today)
    So as I have heard nothing yet can I serve the Judgement today or is that just when the court has to get a reply by before they send a letter to me.

    Evening folks,

    It's heartening to see that like myself, plenty of people are getting the standard rejection letter and have since gone on to be refunded. I received the letter on 21st of May and, following the advice on here, called them to say that I don’t accept their decision. They agreed to re-evaluate the case and advised they would get back to me ASAP. 2 weeks later iv heard nothing, called them today only to be told their is no time frame and they wont commit to anything.

    my question is, how long have people generally waited to hear back from them at this stage with hopefully, an offer? Or, what can I do to speed up the process. Already threatened them with court but they basically said its up to me if I choose this option. Problem is, I can’t afford the court fees right now so this was an empty threat.

    Any advice would be most welcome.

    I've been told 8 weeks but I'm pressing ahead with court action once the 14 days is up on my last letter. Looking at a lot of peoples stories on here it has been well over a month before they hear anything, and a lot of the time that is just a partial offer. I want all my money back so I'm ready to take them to court!!

    i like your style but i will have to wait till finances improve at end of month before im able to pay for court, this will have been about 6 weeks since i spoke to them so will hopefully have heard something by then anyway. let me know how you get on.

    I have a feeling that the halifax are playing a waiting game with their customers.
    They are allowing themselves 8 weeks to investigate, then send out a refusal letter with all the associated blarney. If you accept that decision, then you will probably end up with nothing. If you question the decision or complain again they will re evaluate or escalate your claim and you will probably get a partial offer that could be anything percentage wise. If you stuck to the templates on this site,you would have been through the court system or initiated the mcol procedure and you would probably have your money by now.
    This site recommends that you set the pace, thats what the timescales are for, understand that money is tight for most of us and if you have not got it then you have not got it. You could always get the financial ombudsman to have a look at your case(does a good impression of John Inman - " I`m Free")
