halifax bank charges (merged)

    Hi, story so far:-

    Received list of charges and sent off 1st letter 4th May.

    Received response on 10th May with usual letter saying that charges are fair etc. and complaint being denied.

    Wrote to them on 14th May stating that I was not happy with their response and was not complaining, etc. and wanted a full response within 14 days otherwise I will commence court proceedings. Letter was sent by recorded delivery and I have checked that they have received it.

    Well, those 14 days are now up and I have not heard anything. What now, do I chance a phone call to them, I only have an 0845 number and tell them I am putting a mcol claim through, or just do it as they have already had the 14 days.

    Any help or advice would be much appreciated.

    The FO are dealing with a previous case for me at the moment. That was the last letter from the bank re this case today. I intend to print off the complaint form for the FO today and set the ball rolling there. I honestly wish I had the money to take them to court though, adding the interest nearly doubles the claim. In the meantime I suppose I'll just sit back and wait.

    tjclilac you could phone them but its unlikely they'll budge with a response. Take them to court.

    ok thanks will probably do that tomorrow now. bit daunted about the mcol claim process and what I have to put in the claim etc but no doubt I will work it out.

    I've never used MCOL (live in Scotland) but I'm sure someone will help you out with Particulars of Claim etc .... just shout!!

    Its up to you, but your in a position now to start Court proceedings for certain.

    I have read your comments over the last day or so. I too live in Scotland and my branch is in Scotland. Yet I chanced my arm by applying for last 6 years. If worst came to worst (and from info gained on other thread re Scotland) I would have taken Halifax Head Office to court and provided an English address.

    I simply didn't even need to get to that point; I too got a refusal letter. I phoned and was told they would get back to me after reviewing my case. This seems standard tactic and to be fair I offered the bloke 2 weeks to respond. Right on time I was offered less than 1/2 of my claim. The letter noted I had 14 dys to respond or accept. I called the number and was offered the whole cost of claim minus interest within 2 minutes! It simply wasn't worth my going to English court etc for a few quid in interest and today I have nearly £1900 more than I had in my bank yesterday. I think you might not need MCOL or FO if you attempt to call Leeds.

    Hi Deegee, thanks for that. I have no intention of using MCOl because its only a small amount I could use Sheriff Court up here but what with work/kids/school runs I do not have the time to get to the court (nor the money in any case!). When I phoned them this morning they guy wouldn't give me a timescale for re-assessment but I said that I would like to hear within a week or I would take up either Court or FSO. I'm prepared to wait and don't intend to spend anything on chasing this up, so if I don't get the response wanted then the FSO it is. They are currently dealing with another case for me though and their pretty slow, although I imagine they are pretty snowed under aswell.

    well as you know mcol had let halifax more time due to paperwork mess up and lo and behold halifax used this extra few days to acknowledge my claim, well i have tried to get on mcol today and it will not load up due to the amount of traffic trying to use is anyone else having problems like this?
    also how many from halifax have had acknowledgements made and then an offer before it went any further?
    i would like to know how many from halifax have been settled out of court on this forum as i am going to use this as part of my claim should it go any further.
    :rotfl: it's all making my head spin!!!!!!

    Hi Sarah,,,,,I had the same letter and called to discuss the offer and they came back with all my charges ..less interest (which I have complained to the FO ) Altogether it took about 5days from offer then 5 days later it was in the account,,....:D
    Im not really mad...
