Hello everybody,
This is the first time I have used the forum and hope I may get some advice from someone who has had the same experience with Halifax.
I am currently trying to recover my daughters penalty charges for her halifax current account, which are over £1600 and I am at the stage of taking them to court, which they have acknowledged and now have until the 15th of June to file a defence, so I will have to wait to see what they do next.
My daughter also had a credit card with Halifax and I requested the statements going back six years and included a cheque for £10 which they cashed. When the forty day period had passed I tried to contact them by phone to no avail, so I wrote to them explaining that they were in breach of the code and gave them seven days to supply the information or I would report them to the commission. When I had no communication from them in that period I carried out my threat and reported them.
It is now over a week since I reported Halifax and I still have heard nothing from either them or the commission about the information I have requested and paid for. Are the commission just another toothless tiger who the banks treat with contempt ?
I would appreciate any advice on what to do next to get the information I need to continue my second claim for my daughter against the Halifax.0 -
I have send my second letter over 14 days ago and got no reply, i want to send the court letter but although its £120 i cant afford it so how do i send smalls claim letter if i can not afford the cost.
my bank owes me £1945 in charges.

if you are on a low income you can phisically go into your nearest county court and file a claim and they may be able to waive the fee [if you can prove low income] if not you can go through the ombudsman which will take longer but they seem to get results and it cost's you nothing [i actually wish i had gone this route to be honset as the court thing cost more if you have to actually have to attend a court and there is also all the stress and hassel but i started this going when it was just normally a couple of letters and you get an offer] but anyway i hope that helped and good luck:rotfl: it's all making my head spin!!!!!!0

Just received a letter from the Halifax and they say that they have carried out their investigation and believe the charges have been correctly applied to my account !
Where do I go from here ?

i had a similar letter with the same response, this is normal procedure and are aknowledgeing your claim. in my case i waited for them to get back to me with their decision. Thats when they refussed my claim. i was straight on the phone to halifax. I made a point of saying to the telephone operator that i know that i'm within my rights to having my money back cos i filed a claim with my other account and received my money back.
But i do think ive been very lucky, i have seen many people on here actually going to the stage of court.
If i was you, i would send the second letter threatening court action and see what happens. and if you do get refused dont be put off. Get on the phone and tell them your not happy with there decison.

What stage are you at re sending letters? If that was your final letter you either now take court action or (from what I've read) you could phone them and ask them politely to re-evaluate your claim.They took my signature away!!!!0 -

Its good to read so many of you are getting somewhere with claims from the halifax, and wonder if anyone can offer us any help.
I wrote to the halifax in january requesting statements, cheque was cashed then after about 38 days received a letter saying please allow another 10 days, 10 days passes NO STATEMENTS, rang the numer on the letter, just received a message saying you will receive your statements shortly!!!! " weeks ago wrote to halifax explaining i had waited 4 nearly 4 months and that if i didnt receive them in 10 working days i would go to the commissioner. Its now 8 days - no response.
Does anyone have any suggestions, numbers to ring?
I have looked at commissioners website but it looks like that can take a while so would rather avoid that if possible.
