    On Thursday 24th May '07 I sent my Claim for 1025.62.00 Refund from Halifax thru the MCOL website. Today I received their Notice Of Issue from Northampton County Court, stating Halifax would be deemed to have received it by 1st Class post on Wed 30th May '07 (it was posted on Friday 25th); and would have until Wed 13th July '07 to respond or I may ask the court to enter judgment.

    Today I also received Halifax's Customer Relations response (dated, funny enough, on May 24th), saying they are "satisfied that the charges have been correctly applied" to my account so they're rejecting my claim.

    The letter then makes explanations behind the decision, citing "additional work" involved for them when customers have unsufficient funds to cover payments, feeling it "reasonable" to charge for the service (they also enclosed a leaflet explaining their bank charges). It says I can contact the Financial Ombudsman if I feel my complaint has been unresolved, and if I don't contact Halifax in the next 8 weeks they'll "assume" I am happy with their decision.

    From anyone on this Forum who've had similar experiences, I'd appreciate sound advice on how to proceed while the MCOL Notice makes its way to Halifax's offices and when they either dispute the Claim afterwards, offer to pay some of the Refund or not respond at all.

    Should be 13th June I presume, Anyhow standard reply. Carry on, you will get an offer, do not be put off by B***S*** letters. Stick to the template, read the success thread for confidence

    Thanks so much for your immediate reply.

    My post had contained an error - it is indeed the 13th of June '07 for Halifax's deadline to respond.

    I guess I'll have to 'send in the bailiffs' according to Martin's outlined procedure should Halifax not respond or pay up.

    'Till then, Here's to a full Refund.

    well after a 6 week wait finally got the statements oh and the 10 pound deposit
    now for stage 2 apply for my money back

    help i dont know where to start

    ive added up all charges they total arround 1450

    now its the interest im so confused with do i add it from the template table martin has done for us or do i add the statuary interest

    the other prob is i really cant fathom the stat interest how do u add it??

    is it done at 5% off the charges as 5% is a typical lenders %

    or do i play it safe an leave off the interest for now
    but can i add them later or is this my only chance

    You can't ask for statutory interest at this stage, partly because you aren't entitled to it, and partly because you don't know how much it is yet.

    You can refer to the fact it will cost the bank 8% statutory interest if you have to take it to court, but you can't demand they pay you interest at this stage.

    When you work out the interest, you have to use either Martin's calculator for each individual charge or you can use one of the many spreadsheets. You have to work the interest out on the range of the day the charge was made, to the day you issue your court claim. What you don't do is a sum involving 8% of the total amount.

    Hi Everyone recieved an Acknowledgement of Service 17th May can anyone tell me whether to wait 14 days or is it 28 days before a judgment can be filed, help much appreciated!!

    if its been acknowledged, then its 28 days from when it was served.
    halifax bank claimed £4803 (£5863.88 inc%) paid £6143.29 :j
    CapitalOne card claiming £478 (£609.18 inc%) paid £689.71 :j
    Citicards claiming £700 (£888.23 inc%)

    halifax bank (account 2) claiming £543.15 (£564.09 inc%) put on hold due to OFT outcome

    I still have one outstanding account that the great H haven't settled...my loan account. Does anyone have the correct phone number for the " reclaim Loan account charges" dept???? Halifax don't have a clue where it is & I love to have one up on them!!!!!!!:rolleyes:
