    It is not a stalling tactic as such. The banks are allowed 8 weeks to respond to and deal with a customers complaint as per the guidelines laid down by the FSA. This is relevant if you were to use the Financial Ombudsman as you would be required to exhaust the banks complaints procedure first.

    If you are using the court route then there is no requirement to follow those timescales yourself. You need only show to the court that you have allowed ample time for them to respond to and deal with your claim. The process laid out in the main article and timescales in the template letters give sufficient proof that you have attempted amicable settlement before proceeding to court. This procedure has worked time and again as is shown in the Success Thread and were updated only a few weeks ago after discussion on the forum on the subject and people suggestions and views taken on board.

    Hi, 1st time posting on here but have been reading for a while,

    im reclaiming £1300 worth or charges from halifax inc interest
    it took around 2 months to get my statements but after a few phone calls i got them about a month ago. as soon as i got them i worked out the charges and sent the next letter stating i wanted them back 4 weeks ago

    30th april i got the we are looking into your complaint letter giving themselves 4 weeks.
    today i recieved a letter saying that they are still looking into it and i may hear from them soon but " certainly no later then 26th june" im going on holiday for 2 weeks to the usa an the 4th so i was wondering if i should ring up tomorrow and express my dissatisfaction and give them a week before i take them to court or is that too aggressive.

    i am expecting the responce to be the refusing to pay the charges back letter as everyone else seems to have got that 1st but this has taken an awful long time to get even to this stage. any advice as to what to do next would be gratefully recieved

    You can certainly try phoning them and ask them what stage your particular claim is at but I wouldn't go starting any court action before you go on holiday in case you need to respond to the court/bank/solicitor during the time you are away.

    hi, i have been trying to claim bank charges from halifax since 18march. its got to the stage now where they are refusing to pay up because`i agreed to their terms and conditions when i opened the account`. i sent in the `take to court letter` and gave them until today 25th may before i proceed with the threat. the post had been and gone and nothing from halifax. at first i was only claiming the charges now for their cheek i have requested the interest lost also. anybody had the same feedback or success with halifax? tracy

  • Written to the Halifax, Below si a copy of the letter. Please note this is word for word and any typo are what was in the orginal letter!!!

    "Further to your letter, am pleased to enclose the information you requested. I hope this has provided you with the details you require, however if there is anything you wish to discuss then please feel free to get in touch.

    In your orginal letter you enclosed a payment of £10. As the Halifax has decided not to charge for requests such as this. I have cancelled your cheque.

    Blah, blah.


    Shock the halifax are being nice!!!

    No sorry you have all been mislead I have two pages of nothing that tell me very little. I am claiming for my other half and I have a list of dates and figures applied to the account with no explanation as to what has been applied and when so I am unsure I can claim this back.

    I had no idea you had to know gibberish on order to deal with this lot!!!

    Has anyone else had this letter saw a post earlier but cant find it now, help what do I do from this point
  • Fantastic phoned the Halifax, reordered the statments after speaking to customer relations. (sorry went through the call centre) explained that they were useless, couldnt read a letter and had wasted a tree and taken 8 weeks to send this letter of charges.

    The nice lady said she would resend the statments and the funny thing is it will take 8w/d and this isnt even my account!!
  • Great news is at least I know how muh we are owed roughly!! But cant be sure that we can claim all these charges!

    Received a reply from second letter today saying they decline my complaint. Have sent 3rd letter before Court Action. Will keep posted.

    Phoned the Halifax again today and was told it is only 42 days since they cashed the cheque even though they recieved the letter at least 3 weeks before that

    They have had 2 months to reply with the correct details

    I have sent the second letter giving them 14 days and then followed this up with numerous telephone calls, been into branch, and complained to the Information Commissioner (who havent replied either !!!)

    Today the guy said they would return the £10 cheque although this could take 4 days !!!! to show in the account (what do banks do all day they seem to take the money out quick enough !!!)

    So what now ? going to phone again in the morning and see if i can get someone who will actually help and send the information requested

    Apart from going to there head office and chaining myself to the front door how do you get any answers from these people ?

    This is getting silly now :confused:
