Hi all,
I sent 1st letter to halifax last week [wed 16th may 07] although printer faulty so date on letter 12th may, instead of 16th may. Sent rec'd delivery on the Wed last week.
Got fob off leaflets and generic letter 2 days ago [22nd may]. Saying I could contact ombudsman if liked or ring to discuss further.
I used estimated letter from bbc site, a bit from the fool site and the one on here,MSE, merged together, spent long time to make sure was right.
As I used estimates, I claimed for c£270, if mem serves me correctly. I only found one charge from the statements I had for £30 for bounced chq. I looked at other charges in years before where the going back 6 yrs claim kicks in [prior to May 2001]. Here I found 2 or 3 charges per yr. I therefore based my estimated claim on these charges, £30 x 3 x 3yrs =£270[for 3 yrs missing statements]. Account declined in use in recent yrs due to unhappiness with them.
This is an account I rarely use, am -£2 balance with them. So not important account as have others with overdrafts.
The 8% bit was based on the estimated [as not all statements] figure. Might not be totally accurate. No computer printouts sent to me, as per request on 1st letter, if they disgreed with my estimates.
I am unsure whether to call them or send second letter now. I also asked for computer printout in my first letter. I did not find all the statements online as access trouble.
Any advice?

First Direct:
I claimed c£379, if mem serves correct in 1st letter. Only found £110 in actual charges, some statements missing. Also used estimate of charges from BBC site, merged with Martin's on this MSE site, also added bit about removing any defaults and other bits [from fool site].
They sent 'without prejudice' letter 2 days later offering the £110 but no interest, saying had reviewed account, this could be true, no way to prove, they may have just used my figures for charges on statements for definite!!
Not sure whether to pursue for £23 in interest too or accept £110. there is small chance of other charge/s too.
Other financial institutions' claims pending.0 -
You need to read Martin's article and the Reclaim Help Thread regarding the interest as you will only get the 8% interest should your claim progress to the court stage.
As for estimating your charges, well I can't advise you there either other than the fact that I wouldn't go to court with an estimated claim as you have no proof that what you are claiming is correct.0 -
Hi, all. Just got a letter from Halifax. my claim of £2144 turned down. So moving on with the next stage. I'm incensed to say the least. Sent my claim off on Monday and by Wednesday they'd dismissed it! The cheek of it. I'm pressing on....0

I am helping a friend reclaim charges from Halifax and she sent her letter in, they wrote back saying they would look into it and get back to her within 4 weeks, and now they have written back again and said they are still looking into it ..... what should she do? Can anyone help,i'm not sure what to do.
I have been trying to get my bank charges back from halifax now for about 7 weeks.I sent the first template requesting my 6 years statements.Then i sent the second letter stating how much i wanted back(£6500).
I gave them 14 days to give a reply.They sent me a letter after 2 weeks saying they will investigate into my account and they would reply within 4 weeks.
After 4 weeks they said they are still looking into the subject matter and they would need a further 4 weeks in which to do this.That was monday.
I'm unsure what to do,i think they are stalling for some reason.
So my question is this.Do i give them the 4 weeks in which to investigate,or do you think they are taking me for a mug and i should proceed to the small claims court.
Any thoughts would be very grateful especially from martin lewis.Thankyou0 -

Why tell them they have 14 days then wait 28?
You set the timescale not them. The 4 weeks they tell you is BS.
Please do some reading on the forum before blindly following templates and internet articles. It isn't as easy as the articles maintain, times have changed since they were all written. You now need to know what you are doing.Hamsters have no tact and diplomacy, nor do they want any.0 -
