I sent a letter to the Halifax on 18 April asking for my statements from the last 6 years. Does the 40 day allotted period include weekends or is it a straight 40 days because as yet I have received or heard absolutely NOTHING!! Is this normal or am i being ignored ?? Please advise !0

I'm at a similar stage - have a two inch thick file of corresp. since last December when I started the process - finally told by Customer Relations that they would not even consider my case until I issued a summons. I claimed with MOL, complained to the Info. Comm and Fin Ombuds. Then, on Monday Halifax sent me a letter asked my to accept 40 percent of chgs - they also immed. transferred 750 to my account. I telephoned straight away saying that I would not accept 40 percent and said I would accept 100% charges and court fees and the guy said fine he would offer full 100 percent - I asked and what about court costs and interest - he said they can't do anything about that. Then this morning got another bizarre letter from the guy I spoke to at the Halifax yesterday saying that their final offer is 40 percent take it or leave it. Gosh this is stressy - it's like waiting to see who will break first - not very professional and I think the Halifax have forgotten that we are still customers. Anyhow I've got 750 from the Halifax sitting in my bank - they have acknowledged my MOL and I expect at this stage I'll meet them in court and they have made me so cross I'll be claiming my full 100% chgs, all costs including my time and MOL plus full interest. Had it been alittle more professional and amicable and not got to MOL stage I would have settled for 80% charges and would have accepted my knuckles rapped for incurring charges .........................you know the story.0 -

Steve, 40 days include weekends - however welcome to the adventure. I had most of my statements was just missing a few - despite sending the standard letter and a cheque for £10 twice I have still never received these missing statements - now waiting 6 months. You need to start phoning and bombarding the bank with letters - otherwise you will just be ignored. Also make a complaint to the Information Commissioner - they are snowed under with similar complaints and at the moment and sending monthly batch case complaints to banks - complaints from customers similar to yourself and me who have never received their requested bank statements. Phone the bank now and remember from now keep copies of all correspondence and notes of all telephone conversations. Good luck.0 -
Hi I wouldnt bother sending a cheque off to halifax for your statements they ignore u and cash the cheque. I went into my local branch where a lovely woman sent a request for me and said she would make sure I got them within 10 days. And I did. Thanks to the lovely lady!! Sent my first letter off. hi unfortunately I know exactly where you are coming from I sent my letter 12th April and am still nowhere! Phoned customer services who advised they have no record of request and will issue my statements!
Think the best think for you to do is give them a call and chase them - if they state will take up to another 40 days advise that you will be issuing a complaint to the information commission! just try to be as polite as you can, after all, people tend to do more for people that arent agressive!0 -
just called up halifax to see what was going on and they said they need a full 8 weeks to investigate...ah well to the post office we go to send the court threat by recorded delivery.

Having finally recieved my statements today i have noticed that they have charged me for a interest chargeoff of £408.74 and a other fees charge off of £325.00!!!
I rang halifax up and she was quite friendly and told me to make a photocopy and send it to her personally as she is the manager and she will investigate it and give me a response within 1 week.
but it still doesnt explain what the hell these chrgeoffs are though!!

I wrote my bank a letter before action letter saying I want my money within 14 days or I'll go to court. their response was a rubbish offer or 125 out the 490 im claiming, unfortunately I didnt do anything else untill I found the letters and my files today. they say in the offer letter that if they do not hear from me within 8 weeks they will assume that I am happy..... Im not happy but that letter was sent on 27th september 2006. can I still just take them to court now even though its months after? or should I send another letter before action note rejecting their offer and setting a new deadline for them?0 -
Greetings all, New boy ere in town. Just a small post to let you all know that I have after 3 months, 4 letters, last being LBA, have now completed MCOL in order to get back £171 plus statutory interest from Oward at d Alifax.
In spite of the Bewick case heard in Brum last week I am not put off atall. I have issued the summons in the name of the chairman as I couldnt think of anyone else better to name! 3 of my letters where ignored. I got the std acknowledgement then nowt. I even called several times tosee what they were playing at, all the usual, system down, cant find case file, transferred from dept to dept. Finished last fri when I rang again to inform them that they had reached my deadline, got some crap about "we have 8 wks to respond blah blah blah" fro msome coorporate robot. They have had since Feb 26th to sort it.
I expect to go all the way & now need to prepare my court bundle just in case so any advice or pointers will be warmly welcomed.
