PS. Thanks to everyone on Money Claim. The support of people in the same boat has been priceless.

If I was to do it all again (which I might with an old & closed capital 1 account) I would not worry as much!! Happy claiming:beer:

Hi Everyone. Well, now that I've had my Halifax account for just over six years I've been inspired by you all to go get the blighters. Had my letter already to post when I noticed that some of you have been calling up instead, which is exactly what I did, at 1am on a tuesday morning ( dont worry, I had the week off work!!!) Now, perhaps calling at that ungodly hour helped a bit as I spoke to a very nice, sympathetic member of staff who was quite happy to help (and slip in a little advice for free:p ). She did say it could take up to 40 days unfortunately because of the high amount of request's there have been, but would do what she could. O.k so I'm still waiting for them, but I guess the little advice I'm trying to give is, If you are at all nervous about claiming, call up in the early hours, it made it a lot easier for me...... Wish me luck folks.

  • Hi,

i had papers served on the Halifax almost two weeks ago for the return of unfair bank charges. Have just received a letter from the courts this morning informing me that Halifax intend to defend the claim in full. I was informed by the courts that the acknowledgement was filed by the solicitors acting for the defendant (Halifax) who have given the following name and address for service of documents.

    Hboc
    Legal Services-Retail Division
    Trinity Road
    Halifax
    West Yorkshire
    HX1 2RG
    CL/6/LS/RD/EP

At this moment in time i am thinking do i take this all the way, can anyone advise me. Has any bank as yet appeared in court and if so, what was the outcome???

I've just had a phone call from a bod at the Halifax. He sed that he's looking at my case right now & will be writing with an offer "as a gesture of goodwill" later today. Does anyone think I should ring him back and try to negotiate a higher figure (all of it, dammit!!!) or should I wait until the letter arrives?? Knowing my luck, the letter will probably arrive on saturday and I'll have to sit on it til Tuesday.....

Claimed £741 originally from the halifax. But they didnt play the game. So itook them to court. They then kept messing me about regarding my so called overdraft.
They said they would pay me the full amount (£741 + £80 court cost) but would deduct £75 due to my account being overdrawn. My account was £2 in credit and they took two lots of charges out. Taking me overdrawn. So no i was going all the way.

Judgement was issued on the 20th April 07. For two weeks i called them. on three occaisions was told that the cheque had been posted. by the 10th May i had enough and issued a warrent. How can they lie and expect me not to notice???

Within a few days i received a letter from the legal team. I called them to rectify this matter and was assured the cheque for the full amount would be posted. This was Friday 18th May. Come Tuesday still no cheque. I called again and was told that it in fact gone out on the Tuesday first thing and she apologised to me.
Today is Thursday. Still no cheque. I called the court so they can action the warrent. And was told they have recieved a letter from the Halifax to say that they have paid me direct.
Called the Halifax to get yet another apology and be told that she has the cheque in her hand, How had they managed to get a letter to the court but not managed to send my cheque??

AS far as im concerned i dont want the cheque now. I want the Bailiffs to go in and take them for every penny they can. I want them to know they cant Lie to people and think it wont come back at them. BANKS ANNOY ME soooo much.... TO anyone reading this.
TAKE THEM FOR ALL YOU CAN... after all they have been doing it long enough.!!!!

    Total Money Due: £741 + £80 (court fee) + £55 ( Warrant)= £876.

DONT GIVE UP AND NEVER SETTLE... thats my advice as they are just waiting for people to back down.. I WILL NEVER BACK DOWN EVEN IF I LOSE.... Their name is more important to them then mine is to me!!!
