    Well Just had the shock of my life, checked my account and there were two cash payments totaling £2051 which is the amount of charges I asked for before I went through mcol. On going through mcol I asked for court costs and interest. I havent had a letter so not sure what to do.

    Any advice

    Hi everyone,

    I have a bit of a dilemma and need some advice.

    Yesterday I claimed through MCOL for £515 in charges plus £94.20 interest from Halifax Credit Card Services.

    This morning I received a letter from Halifax offering me the £515 charges but no interest.

    If I take this offer I will lose the £80 court fees and £94.20 interest.

    What should I do? Call them and try to get the offer increased? Hold out for the lot?

    Any advice would be greatly appreciated.

    Someone with more knowledge would be able to advise you better than me, but this is my understanding of it.

    they did the same to me too (Halifax) after 8 weeks i get a letter saying that the charges are all correctly applied and som on............

    but i m not sure wat i do now ???????

    A bit of advice please. We recieved a letter today (14 days after sending stage 4 letter), saying they are still investigating our complaint and will get back to us within a month.

    I telephoned the number on the letter and spoke to a rather aggressive young lady who didn't even want to take our account details. She just said 'The Financial Ombudsman tells us we have 8 weeks to investigate and his word is law'.

    My feeling is to just get on MCOL and start a claim, but is this the right thing to do???? We've done every stage as written on here and kept copies of everything, sent everything recorded delivery etc

    The FO advises that if you have a complaint against a bank then it is reasonable to allow 8 weeks for them to investigate, but this is no normal complaint - this is about the banks unlawfully taking money from our accounts with no relevance to the costs apportioned by themselves in doing so. This is where, we believe, they are breaking the law - a matter for the courts.

    Thanks for that. I think I just needed a bit of reassurance. I'm off to start the MCOL claim. I'll let you know how we get on. We are claiming £1506.31 including interest.

    Hi all.

    wrote to Halifax at the end of March to request charges of in excess of £2000 be repaid. Got the usual "Sorry you are unhappy, we have 8 weeks...... but will try to respond in 4......" 4 weeks later to the day "We need another 4 weeks....." 8 weeks later again to the day got another letter, which in a nutshell says "You are not getting your money back..... if we don't hear from you within 8 weeks, we will assume you are happy and consider the matter closed"

    Of course I am not happy....:mad:
    Funny thing was that the letter had a direct telephone number on it 01977.... and not an 0800 or 0845. So I rang them and said that I would like them to re-evaluate my claim and pointed out that them taking their charges was swallowing up child benefit that is paid into this account and that that contravened section 185 of the social security act.... if i didn't get my money back then off to the court we go...
    The man was helpful and understanding and said that he would personally have a word with the person that had made the decision and ask them to reconsider their decision. He then said that i will receive a letter from them within the next 2 - 3 days.....

    My questions are:confused:

    1. Has anybody else been in this situation?
    2. What was the outcome?
    3. Do you think they were trying to fob me off with the letter to see if i would just go away?
    4. Has anybody got any ideas what will happen now?
    5. Do you think they were trying to stall for more time... ?
    They asked for 2-3 days not 8 weeks

    I also got the distinct impression that when i rang them they realised i wasn't going to go away..... I am prepared to go to court, but would rather not if I don't have to.

    Any views on the above would be very grateful.
