Hi,
Can anybody tell me how the much the court process costs? I am aware that this can be claimed back on settlement, but I am unsure how much I have to pay out to begin with.
Any help will be great

The range is between £30 and £120 depending on the amount you are claiming for, ie, if you are claiming between 2k and 5k (the max) you will pay £120, a lot I know especially if you are in a sticky situation - but you automatically add this to your claim and will get it back WHEN,not if,but WHEN you win

there is a thread with the amounts on. ( not too sure of the link but think it is in the mycol help thread) my claim was for just under £5000 but with the interest added on it went over £5000 and cost me £250. just be aware that it may cost more than you anticipated :eek:halifax bank claimed £4803 (£5863.88 inc%) paid £6143.29 :j

What should I do next???
I wrote my 2nd letter asking for charges back - I now have a letter from them saying they think the charges are fair and they regret to advise they are unable to refund the charges in question as they were applied as per original agreement.
Should I phone them, write to them, take them to court????0 -

It sounds to me they are being hard faced i would give them a ring and see were you get from there if you get no luck and your 28 days are up take them to court0 -
Hi I have just been sent this exact same format letter this morning. I have been trying to call them on the 01244 693854 number, but guess what...its engaged constantly!!
Have you taken this further yet? Has anyone else out there? Should I send another letter or go straight to the courts?? Its not even for much money, but I am loathed to let them win.
I also reclaimed joint account charges at First Direct, they were exceptionally quick and paid up straight away.
My first letter to Halifax was sent on the 16 Jan, they then said they had not received it, so I then emailed it on 21 feb, they have then sent me 2 further letters trying to buy time. then today 4 months after my first letter they send me this rubbish standard letter declining me. Sorry I will get off my soapbox now.
Any help or advice greatly received.

I have received one of these too but i have sent them the letter threatening court action and sent it recorded delivery. now awaitning reply.
Don't let them put you off, it is your money x x
I have also claimed from Barclays and they sent a letter basically saying that i agreed their terms and conditions when opening the account. but sent them the letter threatening court action and they paid up 'as a goodwill gesture':rotfl:

Hiya Stu,
Just carry on with the process and stay within YOUR time frame, don't let them put you off. they are stalling to gain interest on the money before paying it out.

you are right about sticking with your time frame and not theirs, but as for them gaining interest on it...i believe that the banks are making a huge mistake because for those that take it to court (like myself) they end up paying the full amount plus interest plus costs so in the long run it will cost them more i would think :rotfl:halifax bank claimed £4803 (£5863.88 inc%) paid £6143.29 :j

:mad: :mad: HOW BLOODY RUDE!
I sent my letter off in march giving them 14 days to reply for the total charges of £1300. i then got a letter back sating we will have this case resolved before 22nd may, so i though ok i'll wait coz im going to take the 1st offer any way i couldnt be botherd with court.
i got my letter today from Emma Williams and it states:
she has investigated my charges and all the charges issued have been correnctly applyed on my account.
she said i agreed to the terms and condtions regaring the leval or charges on my account when i opened it.
then they went on about how they could help me our and just rang off a list of how i can bank with them. and insuled me by offering me an extention on my overdraft! (which is not going to happen as the refused that last week when i requested it gets extended)
she went on to apologise about REJECTING my compaint!
She sent me out a leflet with all the info about the charges and if she has any more problem she would be keen to reslove them, but she also said if i have any more problems go though the financial ombudsman Service.
And if they have not heard anything within the next 8 weeks they will close this compaint.
I know i need to send them a letter now but what do i put in it! how can i counter that without taking them to court! (coz to be honest i really cant aford to go though the courts at this moment in time)

Thanks for the advice - and mine was like yours, Andrew.
Is there another letter template to send them? What do I say - pay the money back or I will take them to court? I imagine they try this technique most of the time.
