Yeah, I sent my first letter in early december...After countless letters and phone calls I finally received the last of my statements yesterday...After so much mucking around on their part, I feel obliged to press for the interest as well. So I'll be asking for £4020.03 a week on tuesday down at the local county court. They really are cutting off their nose to spite their face...pity they're using our money in the process though...0

Just got a letter back from Halifax saying the following:
"I have carried out a full investigation into your complaint and I am satisfied the charges have been correctly applied to your account.
When you opened your account, you agreed to the terms and conditions which explained that the charges would be applied if you did not keep to the terms of the account. This information formed part of your agreement with us and we have applied them strictly according to the terms agreed.
I am sorry to advise you I am declining your complaint. If you still remain unhappy you can refer your concerns to the Financial Ombudsman."
Is this a standard letter? If so do I push with the court claim? Any help would be gratefully recieved
I have just received exactly the same letter and i'm now just going to a MCOL on them.Cheeky gits.My sister had her charges refunded to her within a month from first letter but i got a longer drawn out process just my luck.0 -

This is my first go on here 'though I have been keeping an eye on other peoples stories since putting a claim in for unfair charges.
I have recently recieved the standard refusal letter from the halifax, so sent them the pay up or else court letter giving them 14 days to respond. have had no reply so will be starting MCOL.
Any body had any responce from one of these from the Halifax and what do I need to do if it goes as far as court, do I need to be there in person?
Any help in this matter would be helpfull

Having monitored this thread for a few months now, it is interesting to note that not one of the major banks have a set routine into how they deal with our complaints.
They may use this as a tactic to dissuade, confuse, intimidate, delay - call it whatever,thay know they are on a loser and are trying their damnest to limit the damage being caused to them.
With the Halifax being in the opposite corner from me and having until 28/05 to submit a defence with the courts, I would like to know what gos into a bundle if you have to go to court. From reading this fantastic site I have the following that I think will suffice
1. Charges( amounts and dates).
2. Calculation of interest.
3. Communications between the two parties.
I know that my main argument will be based on the fact that I will want them to provide details of how the charges are made up and once they make these charges are they in proportion with amount of work gone into them.
We all know they are grossly unfair and unlawful, but but beaing in mind the recent Lloyds/tsb case how do we prove to a judge that they are not.
I am thinking of writing another letter to the Halifax asking them again to provide a detailed breakdown of the charges and how they justify charging the amount without profiteering from it( they are breaking the law) and of course offering them the chance to settle for full amount at this late stage, this can then be added to my bundle whether or not they reply, as it shows I am trying to be negotiate to the judge if it gos that way.

hi all
i wrote to Halifax over 8weeks ago and have just received a letter in the post this morning it just states how much i was overdrawn an the dates when i was overdrawn.
I'm not sure how much they charged for been overdrawn.
can anybody help as to what i do next?

i am pretty much in the same boat as you right now...court papers were served on the Halifax 11th May and so far ...no responce. They have until the 25th May to register a defence. Unfortunately the 25th falls on a friday so will have to wait until monday 28th to request a judgment providing there is still no responce from them. Willkeep you all posted as to the outcome...good luck with your claim.0 -

You've some interesting points there! Because the court system is designed so that people mediate as much as possible and only use the courts as a last resort, this will give you the moral high ground! I too am, waiting until the 28th ( a bank holiday..rats!) so I will be filing on the 29th instead, presuming it goes that far:rotfl:0 -

Can anybody tell me how the much the court process costs? I am aware that this can be claimed back on settlement, but I am unsure how much I have to pay out to begin with.

I phoned the 08457 203040 number press 4. Got through to a very nice bloke and he filled in a form to request my charges and said they will take a couple of weeks. I'm not in a hurry.0

re Halifax charges yesterday I had a letter from them saying it will cost the Halifax money to defend the case and it isnt worth it so they are paying me the full amount I asked for and I will get the cheque within the next 5 days fingers crossed, today I had a letter saying that the charges were legal and fair!! one department doesnt know what the other is doing I am waiting with baited breath for my cheque of £1262.970
