Thanks.......spoke to them and they say no problem. They only change the status to served if Halifax acknowledge the claim, this gets them another 14 days so I might be in luck and not get it acknowledged and then will be able to gain Judgment 14 days before which I need as going away for a month on 20th June!!
One thing they very helpful lady on that number said was that I had issued to a PO Box....did you do the same?? Only prob she says with that is if want to issue a Warrant or send Baliffs in then we need alternative address.
The letter from the court says, It will be deemed to be served on the 14th May. The defendant has until the 28th May to reply… (14 days.) Thankfully only on issue status on MCOL.0 -

Hi, first post here so hope someone can help. I put my claim in to Halifax last week for just under £1000, got a letter this morning saying the charges are fair blardy blah so they won't be doing anything further about it. I was just going to send them letter 3 saying I'm not happy and I intend to go to court etc but read that some people had rung instead so am tempted to do that if I can muster up the courage!. If I am sending the letter do I send it to the guy who wrote the letter to me? is it likely to have any effect or are Halifax generally taking it to the wire without giving in at the earlier stages? I always knew that it might come to this but to be honest shelling out £120 is going to hit me hard (no credit available unfortunately to do it that way) If I do pay up how long does it take to get to the court stage and then hopefully get it back when I win (thinking positive there!)
I am still waiting a reply from RBS having put the claim in then sent the third letter last week - I have had no contact from them whatsoever. that claim is for over £4000 so it looks like I am going to have to go the whole way with them as well.
I felt full of resolve when I got my statements and added up how much I had paid these two banks over the last few years - no wonder I ended up in such a mess I had to remortgage my house to get out of the mess I was in. I was absolutley livid. Now after one letter from the Halifax I feel demoralised! I'm going to have to toughen up and getting into fighting mode again!

I must say, although we are all getting a disappointing response from the Halifax, it seems we are all receiving the same letter and they have change tactics somewhat. I am issuing the 3rd letter to say that I will go to court and giving them 14 days to reply. Hopefully this will work but if not, it's time to go legal on them.

I thought I may do this also but after the letter stating the 8 weeks to investigate, I just started the court route after the 14 day deadline given in my letter....
I am now at the stage where I received the we are happy the charges were issued properly bla bla bla....That came yesterday, Today is the last day of the 14 days for entering a reply / defence in court, so I thought they had sent the letter and not replied but, they have entered a reply yesterday, (not a defence), so they now have until 30th may to file a defence...
I guess what I'm saying is, get legal on them, this way at least you get a timetable to stick to, as if you do letter 7, (I skipped this one), all your doing is giving them another 14 days to reply to it before you can get the ball rolling in the courts...
By all means ring them but I have not as of yet, I'll wait to see if they enter a defence, if they do then I will ring them, if they don't then I'll enter judgement....

Hi ya, I know how you feel it can get you down but chin up I didn't take them 2 court I waited the week's that they wanted and got the not payin up stuff at the end of it so I rang the guy on the letter sayin I was not happy and was going to take them to court and he said they would look in to it again,, about a week later i got a letter with an offer which a didn't like so rang back (see successes thread). . .. long n short of it is i now ment to be getting £5000.00! can't wait

calling halifax now...."customer relations"...wow they have a bank charges option...lol...seems they are prepared for this...will keep you postedScrimping and saving!0

he's going to process the claim again and get some sort of offer out to me...lol. he will re-investigate it. quite polite but reading from a script. said its a grey area and the law only applies to credit cards. have to now wait upto 8wks for a reply. should i wait or send off the court threat to them?Scrimping and saving!0

This is probably useless information, however I have quoted it to an advisor, who told me that they did not have the resources available to deal with my request (statements which I still have not received after 60 days)

Just received the court papers today tlling me the Halifax are going to defend my claim.
Waiting for the paperwork to arrive but the top and bottom of it is, great, Let them try and defend it. They are just delaying the process further to buy time. That money is mine and i want it back.0
