Hi Everyone, hope you all had a good Xmas & are looking forward to a fantastic New Year.

Wondered if anyone could advise me please? I sent DPA to Halifax on 12th June & got acknowledgement after about 6 weeks, then nothing. I wrote to them again on 29th November, advising they only had 40 days from original request to send statements & asked for my fee back as I've not received them & it's well past 40 days, but they've said that, as I got acknowledgement within 40 days I cannot get my fee back (not really bothered about the fee) & no eta on the statements. Where do I go from here?
I've re read the letter & it says I have to request the information AGAIN, IN WRITING, so I called the number on the letter & was given the run around, then eventually told to call back on Tuesday as the dept I need to speak to isn't open, though they are suposed to be there till 12, & the lady I spoke to said that she could order them for me & I could have them by next week but she didn't want to do that incase they have already been ordered!!!. Has anyone else had this kind of bother. When I've read the forums, they all seem to be so straight forward

Don't bother phoning them. Just send THIS LETTER recorded delivery.

  • Hi all, I've been reading the MSE forums for quite a while now and finally have a good reason to sign up and make a post! - Well done me :T

I've seen all the success stories of people claiming money back from their banks and I would like to jump on the bandwagon! - But do I have a case?

I received my first bank charge of £30 from Halifax a couple of days ago. I received it because a DD took me £33 over my overdraft. Now in Martins article it states that the charge must be in proportionate to the amount over the limit for it to be deemed illegal.

So do I have a case? And is it worth the effort for £30? Especially if I have to pay at least this amount to start the court process rolling (even if it does get refunded if you win)

Some advice would be very much appreciated!!

    Kind Regards

Personally I would not commence court action against your bank for a £30 charge. In my opinion it is too small, it would take to much time and cost more in the long run (yes you would get it all back if you went to courth though).

In a situation like this, I would just call Halifax ask them to refund the charge politely and usually that should do the trick.

If they say 'no' ask to speak to a manager/team leader and ask them to refund the charge.

If you have no luck, which is doubtful as most banks would refund this charge to you. Then send them a strongly worded letter asking them to refund the charge otherwise you will take them to court.

Halifax I am 99% certain would rather refund you the £30 than risk it going any further for such a small amount.
  • I sent off my acceptance for my £127 from Halifax about a week ago now and had put on the slip that i accepted it without prejudice and also on the assumption that a £28 charge that was due to be taken out on 30th December did not come out.
checked my bank today and they've taken the £28 - what should i do? i sent the acceptance off in their pre-paid envelope supplied but kept a copy. should i ring up - there is a contact name and number on the offer letter?
    thanks.
P.S. still havent received my £127 'goodwill gesture' either.
    thanks.
  • I sent a letter to the Halifax a couple of weeks ago requesting what charges I had incurred in last six years. I sent the letter to my own branch and have just read another thread of where I should of sent the letter to. Does anyone know a phone number for Halifax that I can check and see if the letter has been passed onto the right department or should I assume that my branch will pass it on. The cheque I posted hasnt been cashed yet. I did receive a letter a few days ago saying please find enclosed a booklet of our bank charges, could be coincidence or maybe this is standard practice after requesting statements.

    Any Advice

    Niki

    Hi Niki
Your branch will pass it on to the relevant dept. Good Luck

Just received my second lot of statements ... (other account...letters already been sent)
Anyway...been going through the statements.....and most charges are at the end of the month...so statements are quick to check....but have just noticed that from 2004....the charges are applied at various times through out the month.....
So be careful not to miss any charges.

Reckon I may have missed some from the other account .
    Have lots more ‘Pending’
    But total money I’ve received from Cashback Sites by performing 'Daily Clicks' is ;
    APRIL 2007 - JAN 2008 = £2,800:money:

  • Wish me luck. My statements arrived this morning...all 102 pages of them so I'm about to send off a letter by recored delivery, incase it gets 'lost' in the post, for £1,488.83

(If you call Halifax and ask for the statements they charge you £5 and they arrive within 5 working days..much quicker and cheaper than sending off a cheque for £10 in the post and it getting passed round departments)
