  • Thanks for the reply Rex. I do understand your view on the lower offers. The only reason I made the offer was to hope it would speed matters up, and maybe avoid court, as I have read similar testimonials from others here. The lower offer was roughly the sum of the charges but without interest. The letter I sent howecer did state that the lower "Without Prejudice" offer was for 7 days only otherwise court action would be taken for the FULL amount AND court costs. Lets just hope for the best now.

    Also, I'm currently claiming benefits at the moment for the first time in my life, after some unforseeable circumstances, and I have heard that I should be able to get the court costs paid for me - I dont suppose anyone knows how I go about that (and if it delays matters) - should I be able to do it on the moneyclaim site, or would I have to do it with the paper form at the local court office?

    So, should I start the claim now, even though their 7 days isnt up, but they have replied saying my letter was passed on, or should I give them chance to get in touch till the 7 days is up on the 30th (Saturday)? Appologies if this appears to repeat the prev post, but I just don't want to make any more unnecesarry risks.

    Did you accept these gestures of good will? Sounds like you are dealing with the bank on the phone which you really shouldn't do but should ask them for everything in writing as you should put everything in writing.

    Yes I did over the phone because my benefits was paid in the same day and had no other choice.

    still going ahead with the 1st letter though

    Once the 7 days are up, start your claim.

    You can get the court fees waived if you are on benefits. You must issue the claim at your local county court for this though.

    To issue your claim, you need to fill in three copies of the form N1. I would get a few spare as well (in case you make a mistake when filling one out). When you pick up the N1 forms, speak to one of the court personnel. They can advise you if you are elligible for a free claim. They can also advise you on what you would need to show as proof you are on benefits.

    Just make sure all of your future communication is done by registered letter and good luck.

    i've done it - claim submitted online. i decided that the reply to my second letter from Halifax doesn't constitute a "full response".

    anyone know why the online court system has allocated the claim to Northampton County Court when i live in Sheffield? As far as i know Sheffield has a combined court.

    I have just received my six years worth of statements from the Halifax. Unbelievably I have totalled my charges and they come to a staggering £1924. As a single parent you can imagine what this money would mean to me if I could get it back.:rotfl:

    I have set up a new bank account with the Abbey:T so now is the time to start. I'm very nervous about doing this, especially because of the amount involved. Can anyone out there reassure me that it will be worth it and that I've every chance of success:confused:

    Any response would be greatly appreciated and any moral support would be even better.:beer:

    Just read this thread from the start, that should give you the idea on how people have gone on :D

    I've just sent them my second letter saying I will be taking court action in 7 days :D
