halifax bank charges (merged)

  • Just sorted out my second letter as they have had the 14 days by Friday. I was going to give them a little more time with the Christmas period but thought better of it, they didnt give me any extra time when taking my money out of the account!

    Any ideas what the " Solve it ref " is all about, many others on here had one?

    Follow your time scale and start the court proceedings.

    my only concern with starting the legal process is that the template letter from this site states "I look forward for a full response to this letter within seven days, otherwise I will commence court proceedings to reclaim my money".

    As I received a response won't it harm my case, i.e. the second letter only mentions "a full response" and Halifax have sort of kept to the letter's request albeit they haven't agreed to refund yet.

    if it got to court wouldn't the question be asked why i chose not to allow halifax the time stated in their reply to investigate further??

    i'm not worried about starting legal proceedings, i just want to ensure i don't scupper things by the slightest technicality.

  • Got my statements yesterday (3 years worth) in 10 separate envelopes!

    Worked out they owe me £1358 in charges,

    2nd letter going off this morning giving them 14 days but if they pay will they send me a cheque or put it in my account which is now been moved to a DCA? Part of my DMP and it is £700 O/D (due to bank charges!)

    Any help appreciated.

    Morning all,

    I had a few "Gesture of goodwill" charges ( I hate that phase ), back in November and although I am currently in the middle of my 1st letter to the bank to claim back all my charges over the last 5 years , will they say a BIG NO when they receive my first letter ?? Will they then send my leaflets to go to the financial ombudsmen ??

    Thing is all my charges total up to over £1,000.00 and I could really do with fighting as much as I can. I have already paid the £5.00 for the whole 5 years statements.

    Any help would be great.

    I do hope I have good news as I got told as I had a couple of gesture of good wills last month I have no hope ??? Yet when I spoke to another person at Halifax they said that's not true.

    Sent my first letter off on the 19th December(already had my statements)got a reply today, just the standard letter stating the terms & conditions etc etc.

    Sent a second letter off today saying that I will commence Court proceedings in 7 days.

    Did you accept these gestures of good will? Sounds like you are dealing with the bank on the phone which you really shouldn't do but should ask them for everything in writing as you should put everything in writing.
  • Hi all, This is my first post here, so I hope it's in the right place.

    I started the reclaim process against the Halifax on Tues 19th December 2006 for a total of £2027.73 (including interest) using the first letter template from this site. (I already had access to all my paper and online statements going back 6 years so I did not need to request these from Halifax). I sent this letter to my local branch, I hope that was the right thing to do...or should I have sent it to head office?

    Anyway, I recieved a very quick reply a few days later (dated 21st Dec 2006) saying they were sorry I was unhappy, and they are basically justified in charging what they do. They also enclosed some leaflets for me, "How to understand your bank charges", "Bank account Conditions" and "Personal Customer Complaints", although none of this literature actually breaks down the charges to justify £39 per charge for sending me a automated e-mail and failing a payment.

    So, I prepared the second letter template from this site on 23rd Dec 2006 (to my local branch again). I also included the "Without Predjudice" part offering a reduced amount of £1750, in the hope of speeding things up.

    Once again, I recieved a speedy reply dated 27th Dec 2006, stating they're still sorry I'm unhappy, and also details of how I could contact the financial ombudsmen if I wished to, and that my letter has been passed on to the Customer Relations Dept who would contact me as soon as possible.

    So, I'm just curious as to what I should do now. I stated in my second letter the Halifax had 7 days before I commence court action. As they have already replied, should I start the moneyclaim now, or wait a few more days for the Customer Relations Dept.?

    I must admit, I'm actually fairly excited now, although still very nervous at the same time.
    I'm so glad I found this site when I did. Many thanks to all here for all the information I've already read.

    Now you need to start your court claim. Claim for the full amount+interest+court fee.

    I don't agree when people write to the bank offering offering to accept a lower amount than the full claim. If you issue a court claim for the full amount, the bank could offer you £1750, then if you refuse it the bank can go to the judge and say 'he offered to accept a lower amount, but when we offered this, he refused the offer'. Now you'e reached the court stage, you should expect to be offered the full amount of your claim at some stage, not any lower offers. Seeing as you've already offered to settle for a lower amount, you could (possibly) harm your chances of getting the full amount back.

  • Haven't they got 40 days to oblige with a Data Protection Act request?

    if a letter of complaint is received at branch - this will be forwarded to customer relations (you will receive your first ackinowlegement within 5 working days) - they they have a good few weeks under their complaints procedure
