  • If you were charged - it will be on the statement as your balance would have been reduced by say £39, for example

    branches can only go back about a year to a year and a half

    Hello.

    Right, I need some assistance regarding my claim against Halifax.

    I sent them the original DPA/SAR request on the 29th September 2006.

    After 14 days, I sent a reminder letter to them. Another 20 days or so passed, so after searching another forum I found out their DPA Department's contact details and I called them directly to ask why I had not heard anything.

    The lady I spoke to said she would look into it for me and call me back the following day. I have had no phone call since, even after calling back again, but I never managed to spoke to anyone.

    I recently posted on this thread stating the above background information, someone as a result recommended I send them the following letter:-

    Data Protection Act 1998

    You have failed to comply with my Data Protection Act Subject Access Request dated 29th December 2006.

    If you do not comply within the next 7 days I shall consider legal action by seeking a Court order obliging you to do so together with damages at the discretion of the Court and without any further notice to your company. Moreover, I shall also report you to the Information Commissioners Office and they will be supplied with all the relevant documentation and evidence as required to enforce your compliance with my perfectly legal request.

    The above letter was sent by recorded delivery, just like all the others, on the 15th December 2006.

    So, the 7 days have passed.

    I am quite annoyed by all of this, so what should my next step be?

    hi i sent off for my statments in november recived on the 13 dec post asking for my refund just had a letter back saying sorry to hear you not happy with the charges and they will get back to me within 4 weeks

    sorry firt time i have used this post, i sent offformy statments in nov and recieved them on the 13 dec,post my refund back to them had a reply saying sorry to hear you not happy and they are looking into it and get back to me within 4 weeks i got my next letter ready to post back to them

    In a fit of anger I demanded 5 years worth of statements, these promptly arrived 3 days later and again 5 days later for good measure.

    I am happy to report that after I sent my first letter on 9th December claiming £2645 worth of charges, I recieved a letter on Thursday offering me £2166. English reserve once again establishing itself in my brain, I have accepted their offer, which was better than a smack in the chops.

    I would just like to pass on my thanks to this forum, on which I have ummed and arred over during many hours of should I or shouldn't I. for giving me the tools(and the bottle) to take on one of the banks.
    hi can you tell me what stage that i am at i recived a letter saying they are looking into my charges and sorry to hear i am not happy and they will get back to me within 4 weeks , shall i wait for he 4 weeks or send them the letter for court action thanks keith

    Hi,

    I am very new to this site. I have been receiving the emails but haven't posted any messages before.

    I have dealt with halifax for years and have received many charges also.

    I read the article in the email and decided what have I got to lose?

    I posted my first letter off to them but I sent it to the following address:
    Halifax PLC
    Trinity Road
    Halifax
    HX1 2RG

    Has anyone else used this address and if so, did you get anywhere?

    Also, can anyone advise how long it takes roughly to receive a reply just so I can keep track of them?

    hi i have used this address and so far o good had statments back really quick, on my second letter from them looking good so far

    Hope someone can help here. It seems the Halifax have sent me a letter that deviates from the "how to" guide.

    I sent the initial letter requesting refund of charges asking for a full response within 14 days.

    I got a reply stating the charges were within the terms & conditions of the account.

    I sent the second letter requesting response within 7 days or court action would commence.

    Their reply was to advise that due to the nature of my request my complaint has been passed to their Customer Relations Dept and my complaint has been allocated a "Solve it" reference number.?? The sentence that causes concern is "Due to the nature of your request I have forwarded your complaint onto our Customer Relations Dept who will review the matter and respond to you no later than the 3rd February 2007".

    3rd Feb 2007? That seems an excessive amount of time even taking into account the xmas/new year break.

    Should I wait until this 3rd Feb deadline?
    Should I write back giving 7 days then start court proceedings?
    Should I start court proceedings now without replying to Halifax?

    Help!!!!

    I have been reading lots about claiming back my bank charges; which unbelievably add up to £2975!! (I hang my head in shame:o !). I contacted the Halifax who stated they would refund me £1000 as a full and final offer, I rejected this and they wrote again offering £2000 - which I again rejected and have issued them with court papers; here is the scary bit - they have acknowledged them and said they will be entering a defence! ARGH:eek: ! Has anyone else had this happen with the Halifax and if so what was the outcome?

    Grateful for your advice; I am extremely nervous now:undecided !
