Does anybody think there is an advantage (if you're on benefits) to telling Halifax that it's no skin off your nose to take them to court, as I wouldn't have to find the court fee? & am willing to take it all the way? Has any found that this works?0

I am on Step four of Martins guide, and i am ready to threaten court action. Shall i send the letter to my local halifax or direct to halifax? If so what is their address?? Skipped through many pages, apologies if missed it.

What if bank (Halifax) denies charges and says that when you signed up for account you agreed to terms and conditions, so tough!
Totally ignore it - dont entertain it at all, just scare tactics, just write a letter back saying 'thank you for their letter' but under the Unfair Terms in the Consumer Contracts Regulations 1999 you will still be claiming the amount owed.
Just keep the letter straight to your point and simple.
Tonight at close of business we had recieved £1223 that was owed and all it took was 4 short letters and the claim filed with the court.
Dont entertain any letters at all where they tell you this that and the other about their terms and conditions etc.0 -
I recieved an offer from Halifax last week for £4398. which I declined. They called me back yesterday and made me an offer of £6k (owed £6405) I thought for a minute, then said no, I wanted the full amount or I was going to the FOS, so they offered the full amount and I verbally accepted. They said a letter would be sent out with the amended amount.
They then said that the original offer of £4398 had already been processed and I would recieve the remainder in approx 2 weeks time. When I checked my account the £4398 had been paid in!
Has this happened to anyone else? I have the feeling I am never going to see the rest of the money

Recieved my offer today for £1238 and declined it ,was offered full amount of £3041 which i accepted .Just checked my bank ballance by telephoneand Hey presto ive been credited with£1238. ill certainly be on the phone first thing tomorrow.0

hi, this is my first time on here so hello everyone. i sent my letter to the halifax on 9th may and received the following letter today and i am confused as to what to do next
Thankyou for your recent complaint. i ams orry you are unhappy about the charges which have been applied to your account.
i have carried out a full investigation of your complaint and am satisfied that the charges have been correctly applied to your account. this letter explains the reason behind my decision.
then it goes on to explain about the terms and conditions set out when i opened my account etc....
i gave them the usual 14 days to respond and they have done this so does this letter now mean that i can start court procedings...its for about £2700

I got this letter and phoned them to say I wasn't happy and would be going to the FOS, I got an offer a week later!0 -

Hey dont give up,i recieved that letter last tuesday and rang them the same day only to be fobed of with the usual "We will take another look at your complaint but it will take up to 8 weeks. Itold them i was not prepared to wait that long and would file court papers, to which they said go ahead its your porogative. I started mcol on thursday and today recieved a call offering me£1328 ,less than half my claim of £3041 inc int & costs i refused this and was then offered full amount.Brilliant result ,so dont give up you will get there!!Thanx to everybody on this site for thier advice and encouragement
Ring them and tell them your not happy with that descision and will file papers to court you may get the same reaction as me but it only took them a week to change thier decision. good luck0 -
