    Everyone gets this letter, or one similar.

    The charges are in the T&C's. The T&C's are part of the contract between you and the bank or CCC. However, contracts have to be lawful. Any unlawful T&C's (ie. the ones about the charges) are unenforcable.

    As Martin puts it in his article, "If someone told you they were about to punch you before smacking you, it doesn’t make it legal".
    The acquisition of wealth is no longer the driving force in my life. :)

    'I have carried out a full investigation of your complaint and i am satisfied that the charges have been correctly applied to your account'

    'When you opened your account, you agreed to our terms and conditions which explained that charges would be applied if you did not keep to the terms of the account'

    ' We apply these charges because when customers have insufficient funds in their account to cover a payment they have asked us to make, this means additional work for us. As a result we feel it is reasonable to charge for this sevice'

    'I am sorry to advise you i am declining your complaint. I hope i have explained the reasons for my decision'





    What do i do now?:confused:

    They owe me just over £400 and i could really do with that money back right about now!

    Send in your 2nd letter stating you are unhappy with there response. Thats what i did and was offered my charges back.

    I got the same letter today. Have just sent off the template letter threatening the Small Claims Court. It appears Halifax are quite tricky....

    OK, I need some help as the length of this post is just mind-blowing. I have avoided reclaiming with the Halifax as I have a large and full credit card with them, but I have just been charged £39 for bouncing a £5 direct debit that I wasn't expecting, and I am very annoyed, so I want to proceed.
    Firstly, is it just bank charges I can reclaim or can I recliam credit card charges too?
    Secondly, are Halifax closing accounts to those who reclaim? I have a large overdraft and have put off claiming in case they demand instant repayment.

    I wrote my bank a letter before action letter saying I want my money within 14 days or I'll go to court. their response was a rubbish offer or 125 out the 490 im claiming, unfortunately I didnt do anything else untill I found the letters and my files today. they say in the offer letter that if they do not hear from me within 8 weeks they will assume that I am happy..... Im not happy but that letter was sent on 27th september 2006. can I still just take them to court now even though its months after? or should I send another letter before action note rejecting their offer and setting a new deadline for them?

    can anyone help me new to this.

    I posted my request for statements on 26/03/07 received a letter on 10/05/07 saying the information i requested has now been ordered & will receive them within the next two next weeks.

    received a letter this morning saying that my request for a refund of all charges has been escalate it to customer relations and they will contact me within 8 weeks with a response.

    can any one tell me if this normal because i still have not received my statements yet so i dont know how any charges i had over the last six years.

    thx for your help.

    Hey dont give up,i recieved that letter last tuesday and rang them the same day only to be fobed of with the usual "We will take another look at your complaint but it will take up to 8 weeks. Itold them i was not prepared to wait that long and would file court papers, to which they said go ahead its your porogative. I started mcol on thursday and today recieved a call offering me£1328 ,less than half my claim of £3041 inc int & costs i refused this and was then offered full amount.Brilliant result ,so dont give up you will get there!!Thanx to everybody on this site for thier advice and encouragement
