    Hi,

    I have just got off the phone with Halifax. I eang to ask why my claim have been declined. She said tuen and cindition were fair bla bla bla. Any way i said was going to take them to court for the two claims. Onw for £836 and one foe £1602. I the ask her if yesterdays ruling with the customer from LLoyds TSB has changed the way they are looking at claims and she said NO! She said it was only a districk judge ruling not a high court judge. So get those claims in!!!:T

    Do we really need to be drawing their attention to the Lloyds ruling. It might make them even more stubborn & conceited than they are now!!! Argghhh!:eek:

    I added it to both letters but made sure I had broken the total down to show the total of charges and the total of interest and what the overall total was.

    Then at the time I had to fill out the claim form to the court I re-calculated the interest up to that date.

    Halifax have just written to say they will pay up all amounts owing including the court fees by the end of their 28 day deadline as they acknowledged the claim to the courts. :beer:

    Tomorrow morning before 9am I will be entering a judgement by default with the courts as the Natwest havent even bothered acknowleding the claim to the court (unless the money lands in the account before close of business today - their deadline is midnight tonight).

    I found Martin's advice so easy and I think the key to was to keep to the point in letters - no phone calls as this can lead to arguements. I have written just 4 letters to the Halifax, sent them all recorded delivery which was just as well as the Halifax tried the 'deny all knowledge' and 'we have been trying to contact you but have failed' tactic and then didnt bank on me being able to so quickly proove a signature of receipt for the letter courtesy of the Royal Mail web site.

    Oh and only wrote two to the Natwest, and one of those was to send the cheque for the statements which I might add they only cashed yesterday, 13 days after I filed the claim with the courts and 10 weeks after I sent it them (they took along time to get them printed off!)

    I cant thank Martin enough for his guidance on this. :beer:

    Thanks for that and suppose i will just have to wait and see what happens on 30th of May to whether they put a defence in or not. Wondered if you had heard anything about cases been thrown out of court because relevant paperwork had not been sent into them. When i did my MCOL I never sent anything. I just have in hand a notice of issue from the court and my notice of acknowledgment.. I have rcvd nothing further and i am wondering if it is worth sending the court a copy of my bank statements etc. cheers. egg on toast.

    Hi Egg on Toast,

    I would only send any further info if they ask for it. I haven't heard of any cases being thrown out of court. In most cases the banks pay up close to the court date because it just isn't worth them paying to go to court. I would just wait it out and you'll probably hear shortly before the 30th. Let me know how it goes, and I'm about to do the same thing. Suki

    What if bank (Halifax) denies charges and says that when you signed up for account you agreed to terms and conditions, so tough!

    That is what Barclays have told my daughter in a letter she recived this morning. saying more or less to wright to the financal Ombudsman. They are not going to pay her charges back what to do now HELP.

    I would recommedn that you keep on fighting. SOme banks do try to scare you off with such letters, but you just have to keep on going. SOme take a while to sort out. I used the letters from this site & modified them to suit my needs. It worked. I am in the process of claiming form the rest at present.

    I've received a similar letter today, although the Halifax has refunded me £500 for two accounts, but they are digging their heels in with the 3rd account. They basically told me about the T&Cs and all, but it doesn't escape from the fact that the charges are unlawful regardless of what we all signed up to.

    Just keep to your timescales of 14 days until you get the results.

    Hi all,
    I had a letter from the Halifax this morning stating that they had investigated my claim and are declining it. I didnt follow the time table because at the time didnt have the money to do a mcol. Can i now send the next letter off to them saying if they dont pay out i will take them to court? Im claiming back just over £2800. Could really do with this money at the moment too! It seems that the Halifax dont know what they are doing and are giving people different answers - while some are being paid before even getting to court they will let some others take it all the way.

    GRRRRRR at the Halifax!!!
