Im new to posting on this site but have been reading for a while.
I received my statements from Halifax and sent off the usual letters to which they replied that they would get back to me by 25th May (8 weeks surprise surprise). Im heavily pregnant and due to go into hospital for an operation and so decided to give Halifax the benefit of the doubt and wait. After reading today I notice that a lot of people are getting declining letters. Can i still take them to Court after waiting the 8 weeks? Has anyone else been successful without taking Halifax to Court? m not sure what to do now.

i got a reply from halifax after two months , but they say they not gona pay the charges back as they beleive that itas thier fee for the service that i used and its their charges, exctra......

Hi Everyone! I need some advice please.
In brief, I applied for my bank charges to be refunded on 3 accounts with the Halifax. A few weeks ago, we got 2 decent offers for the two joint accounts, which we accepted.
They said they would be in touch before May 22 regarding my own current account charges.
We have sent two letters from this website to get this far.
Today I have received a letter from the Halifax re. the last account to be settled. Basically they have declined my complaint, saying that they are satisfied that the charges were applied correctly.
The letter is broken down into different sub-headings ie. "Our investigation", "Why you have been charged", How can we help" and "Outcome".
Is this a standard letter and what should we do next?
Is it a court application now?
I am very disappointed because the charges amount to ca. £800 as I thought they would come back with a decent offer. Also - their logic doesn't make sense - they refunded me to charges on two other accounts, which according to them were fairly applied, so what is the difference here...
Any advice and support would be greatly appreciated.

Hi wondering if anyone could advise on the following;
I am in the process of reclaiming 2,000 back from the Halifax.
Halifax initially advised me that they were investgating my complaint after recieving my first letter asking for all bank charges back and that this would take approx 8 weeks.
After following advise from the chat forum i sent my second letter two weeks later to which they did not reply so a further two weeks later i started my court proceedings againt the Halifax.
The Halifax did acknowledge which has given them a further 28 days. The date on the county court ack is the 2nd of May which to my workings out means that i should be all set to go money claim online on the 30.05.2007 to ask for a judgement. Is this correct???
Also if the Halifax was to put in a defence would this mean i then have to go to court and if so would i need to get a solicitor??? or would i just turn up to court? (not bothered about going to court but really worried about exactly what i would have to say when i get there apart from the obvious "I think the charges are unlawful and want a full refund".
I have also recieved a letter from the Halifax complaints dept today (8 weeks later as they advised) In the letter they say they have carried out a full investigation and they are satisfied that the charges have been correctly applied to my account and that the outcome is that they are declining my complaint. I wondered if this was part of a defence that they will use in court as i have a bad feeling the Halifax are going to take this all the way. Would love to hear from anybody out there who has any advise on any of the above. Many Thanks0 -
I Followed The Links On This Site And Got Over £5000 Back From Bank Of Scotland,put Letter To Them In Jan, Chased Them Up In March, They Offered £3000,we Said No,and Threatened To Take It Further So The Y Paid In Full,but They Said They Aint Paying Interest On It, Now If It Was Up To Me I Would Have Fought On And Tried To Get The Interest,but My Brother Was Chomping At The Bit By This Time And He Just Wanted To Have The Money So He Settled,i Want To Thank This Site Very Much And I Raise A Glass To Everyone Involved In Trying To Get Bank Charges Back For The Poor Man, It Really Made A Difference To My Brothers Life And He Is Smiling Again Now That He Is Debt Free...fight The Good Fight Guys!!!0

I think you have received the same letter as me. I am assuming then that this is their new standard letter. Their logic however makes no sense. Saying that they feel the charges have been applied correctly, could be said for my other two accounts, for which they have refunded me the best part of £500, so I don't know what the difference is with my 3rd account.
I think I am just going to go through the court now. The charges are still unlawful regardless of whether they think they have been applied correctly.
As far as I know, you won't need a solicitor to go through the small claims court. I would not worry about a defense, agreeing to terms and conditions previously etc. The fact remains that their charges of ca £35 are certainly not reflective of the costs they incurred.
Someone with more knowledge would be able to advise you better than me, but this is my understanding of it.

They have only sent the bank account statements though, and there is nothing for the credit card ones.
Should i have sent two separate letters one to bank accounts and then to credit cards or should it all be done at the same location?
Also what do i do next? and what about interest i dont understand it?

As far as I understand Halifax Credit Cards is a different company from Halifax accounts. I would check the H.O address on one of your cc statements.

Thanks for that and suppose i will just have to wait and see what happens on 30th of May to whether they put a defence in or not. Wondered if you had heard anything about cases been thrown out of court because relevant paperwork had not been sent into them. When i did my MCOL I never sent anything. I just have in hand a notice of issue from the court and my notice of acknowledgment.. I have rcvd nothing further and i am wondering if it is worth sending the court a copy of my bank statements etc. cheers. egg on toast.0 -

How many people have added interest when sending the 2nd letter? or have people waited to see if they go to court or not 1st?
If I add the interest when sending the 2nd letter, whats the worst that can happen? just not get the interest added on to the full amount?

Hi all Just had letters for my 2 other accounts declining my claim stating they have investigated and the charges were correctly applied , just going to phone them and register my thoughts on the matter ,nicely of course ,,. Yesterday had the same and they said they would get another letter out to me ... ah well here goes ...Im not really mad...0
