    i've got the same problem in so
    far as they've said it's a "No !!
    " T & Cs" and all that.
    So I've just sent a final !! final !!seven days request/demand, then that's it ,court here we go (as i've got to the
    two letter stage by now - and been told to "do one by them" )

    My questions though are 2 fold

    1 . I've the read the threds on this site and many seem to get a result or offer before getting to the final stage of going to court ,others seem to have to go to the final stage ( like me) Also replys you get back from banks seem to differ from customer to customer,branch to branch ,reading threads on this site, some seem to get a result of payment pretty quick whilst others se em to have to fight tooth & nail -Why? when it's all Halifax?

    I've had it all!!
    One person sez they will post the statements through..next person sez they don't care & are delighted that I am threatening to take them to court!!! next one sez we will post statements...etc!! Just harrass them every day until they crumble!! I'll let you know if it's worked for me!! All the replies I had were from the same department..ah well!!! That's Halifax 4 you...:p

  • I too have had the thanks but no thanks letter today, I am not a happy bunny at all......
    So where do we go from here, Whats best the ombudsman, Or call them directly?

    Sorry if this question has been asked before.. how long should I expect to wait before sending off my 2nd letter advising how much I am claiming back and to getting a reply?

    i have sent the 2nd letter to halifax to claim back charges threatening court action. i used the template letter exactly from this site. Today i recieved a letter from halifax, it said: i am sorry you have not had a full response to your concerns, we're investigating your complaint and will reply as soon as possible, no later than 12th june 2007.



    Should i accept that and wait until the 12th june and see what they do, or wait till 2 weeks are up from the day i sent the 2nd letter and issue a court order?

    The 2nd letter template says i allow 14 days for my money back and then i will issue court procedings. should i follow that or wait till the 12 june?

    Hi all, i have tough decision to make. I wrote my first letter and got the expected reply. Wrote my second letter asking for my money within 14 days or i'd take them to court, and got a reply saying they were looking into it and would get back to me within four weeks I gave them 3 weeks before i decided to issue court proceedings with MCOL(11th May). Only today(12th) i recived a letter dated the 10th they would refund me my charges less the intrest. :confused: don't know what to do next. Has anyone been in the same situation any advice much appreciated.

    I too received the same letter and mine too says no later than 12th June will be interesting to see what people advise.

    Hi Guys

    If my bank is adding charges to my account now do I have any rights to tell them that I didn't authorise them to take charges from my account. My account doesn't have enough to cover the £114 with the charges they are putting on,I just recieved a letter from the bank stating that if I don't pay up within 7 days then they will send my details to a debt collection agency and will also send a reprt to my credit file.

    I also stated to the call advisor that I am currently reclaiming previous charges and they told me that instead of sending the bank reclaim letter they would send the request electronically.

    The bank is the Halifax and one of the call advisors told me that I must pay the £114 with the charges as its what I signed into when I opened the account.

    Can anyone advise me on what I should do?

    I was in the same situation but thought they were just delaying so gave them 3 weeks and issued court proceedings. Only now the next day after i issued the court proceedings i have had a letter offering a refund. Maybe i should off rang them and chased it up, now i don't know what to do as it's cost me money to put them in court. If i were you i'd give them a call to check out whats happening. It may save you the cost of court fees and the extra time you will have to wait for your money. Good luck
