Hi. I followed Martins instructions, and sent my first letter to the Halifax. Gave them 2 weeks (but secretly allowed a couple of extra days because of the Easter shut-down). The day after the second letter was sent to them I had a response to my first letter telling me that they were so sorry I had a complaint, but their "regulator, the Financial Services Authority, gives 8 weeks to investigate and respond to complaints".
I have now had a response to my second letter saying that they refer me to their previous letter and are still investigating but I will receive a reply, definitely by the 12 June at the latest.
The question is, do I wait until the 12 June, or do I do what my letter threatened and now instigate the court claim, as the 14 days were up on Friday????
My husband says I should wait, but I feel this is just a way of them fobbing me off!!!0 -

it's up to you alot of people on here will say keep to your timescale, which is what i done and i'm still waiting for a court date however a friend of mine just waited the 8 weeks (cause she did'nt have the money to take them to court)and she got an offer after about 7 weeks and 5 days. i think to be honest if i was in your shoes i would wait the 8 weeks (as theres only 4 of them left) and then if nothing take it to court but as i said its up to you,good luck.0 -
I've got in abit of a mess in the last 2 months. Have a free overdraft of £1000 that I have never used in the past but over the last couple of months it has been used and I have just gone over the limit 3 different times, so therfore 3 individual letters have been produced and bank charges of £30 each time taken from my account. Can I still use the Martin Lewis template letter to claim this money back, or have I miss understood the purpose of this.
if this is possible can I :
do I write to head office or my local branch
As I have the letters and statements to list the dates etc that it happened do I have to forward the £10 or just go straight to sending the letter
I donot intend to happen again but if it does can you claim each time or is this a one off thing
are the Halifax quite understanding in cases like this.

I think I just might give them a ring tomorrow morning and ask them why it takes so many weeks to look something up on the computer. If I can do it in minutes, why cant they - I ask myself.0 -
after waiting 50 days for my statements. and having already made 5 requests. I finally got through to someone who knew what they were talking about at customer care team at Halifax. All i have been waiting for is 20 months worth of statements from August 2002 - June 2004. I have been told that these statements have just been ordered but i will not receive them in statement form, but rather in the form of a report. The reason, Lorraine from customer care suggested, is that there was 'a change of sortcode' in that period of time and statements are 'unavailable'. Oh and by the way, these will take another 3 - 4 weeks.
I kindly informed Lorraine that this was unacceptable and i will be calling every day for an update. I also sent my complaint letter to the Information Commisioners office (downloaded from Martins site. ps it was really easy, took 15 mins to complete)
I further sent another recorded delivery letter to Halifax requesting information on this so called Sort code change and why i cant have my information in statement form. I am thinking about charging Halifax for every letter and phone call as dessertion costs.
Good luck to everyone still waiting for statements. Halifax are playing dirty. Two can play at that game.0 -
Im in the process of claiming against Halifax. Im up to stage 4 (i think) threatening them with court action. I've got a reply saying that they wont give a response until they have fully investigated the complaint and this wouldnt be before 22nd May (we threatened court action after asking for the second time on 29th March). Do i wait for until after 22nd May or how do i go about taking them to court, I also go on holliday on 25th June til 10th July so I'd have to take them to court after that. Im just confused as to whether i wait for their reply, take them to court (and how i do it!) and if i should wait till when i get back from holliday as i dont want the court to issue a date i cannot attend. Any advice is greatly appreciated.0

Hi Steve,
Firstly it's up to you whether you want to give the bank the time they have asked for or if you want to push on with Court action. I don't bank with Halifax, but what I do is read the threads about my banks and then find out how they are reacting to certain stages of the process. Some banks like HSBC for instance, tend to make a reasonable offer if you allow them the 8 weeks that they ask for, others don't.
When you file for a claim through the court, normally you are asked if there are any dates when you are unable to attend, therefore, you would have the opportunity to avoid your holiday, but not prolong the process by waiting until you come back, although, there could be critical information that may have to be sent that could clash with your holiday dates. So it's a case of weighing up your personal situation really. Nobody can tell you how to proceed really, it's personal choice. The various letters etc., are there to guide you
If you do want to push ahead with the court, you can file your claim through MCOL, although I personally haven't been that far yet.:dance: Proud to be dealing with my debts0 -
Hi all, I have just had a reply from Halifax saying they believe the charges they have applied to my account are correct!!! please help what should I do know, they only owe me £247 but it still was unfair charges, all the threads I have read so far dont say anything about a rejection letter???
any advicewould be apreciated....

I'm in the process of claiming charges from my Halifax account, so far so good. I was wondering if I can claim charges on an account thats already been closed. I had an account with Alliance & Leicester, never used it on a regular basis,somehow managed to go overdrawn when I had no overdraft facility on the account. Because of this they charged me every 3 days for a month, leaving me over £200 O/d before they wrote to tell me, otherwise I would of paid up asap. Anyway I ended up paying up in full and they closed my account. I just wondered if I could claim these charges back as well?
Any advice appreciated.

You most certainly can claim the charges on a closed account!! Especially if the charges occured within the last 6 years. It helps if you have the statements, but if not then you can request them (or a list of charges). As I've found, the bank will probably try to fob you off with excuses such as "we have to go down to the vaults to dust off the paperwork..be very VERY patient..."
Don't be fobbed off by such excuses!! Be persistent and you should succeed!
