I was in the same situation but thought they were just delaying so gave them 3 weeks and issued court proceedings. Only now the next day after i issued the court proceedings i have had a letter offering a refund. Maybe i should off rang them and chased it up, now i don't know what to do as it's cost me money to put them in court. If i were you i'd give them a call to check out whats happening. It may save you the cost of court fees and the extra time you will have to wait for your money. Good luck

I am currently in the process of court with Halifax my claim is for £780 plus costs, the court charge was £80. Halifax then had 14 days they acknowledged the claim which then gives them 28 days in order to file a defence so I am just waiting now to see whether a defence actually does get filed.0

today i got a letter stating the following
thank you for your recent communication regarding the charges applied to the above numbered account
as per the terms and conditions of your original agreement,which you signed to confirm you had read,understood and agreed to be bound by. Charges will be applied to your account on each occasion that the minimum payment is not received by the due date shown on the statement
the statement is sent as a reminder and the onus is on you, the cardholder to ensure you keep the account according to the agreed terms and conditions
after assessing the OFT findings our late payment charges have been reduced as from 1st august 2006.
in view of the above, i regret to advise i am unable to refund the charges in question as they were applied to your account as per you original agreement

ok the majority of my claim is late fee's but only 5 have been charged after this date, i have over £350 in charges b4 this date.
also does this mean as i have a new agreement should i not have had a letter telling me this as any new contract i have im entitiled to a copy
has anyone else had this letter? and has anyone been successful in claiming after this???0 -
Just Halifax speel. I had the same and took it to court. Its just an off putting letter.0

I got that letter this letter this morning....I started MCOL yest0 -
I followed advice from some of you on the reclaim bank charges board - yesterday I faxed Halifax Customer Services and asked AGAIN for my statements, telling them I had waited now for 60 days, and was about to complain via ICO. Surprise surprise, a letter today in the post! Still no time scale given; "the information you requested has now been ordered". Dated
8th May! They are inundated apparently...0 -
I am just off the phone,after being given a number to call on the letter i was then transferred to another dept...and guess what i had to phone another dept as they had given me the wrong number
anyway after speaking to a nice guy at customer relations i told him i wasnt happy and the fact i only have a few charge after that date charged at 12.00 im prepaired to forget them but i want the full amount on the rest
he said hes put a note on my claim and i will get a new letter out in a few days
just shows u that they will try any trick to get you to back off!

Hi all just had a letter from the Halifax about my charge claim ..and they have declined stating the charges have been correctly applied to the account therefore they have refused any refund and given a number for the financial onbudsman ..is it worth calling or go to mcol ...
any help appreciated..Im not really mad...0 -

thats what i got today and i phoned them they told me i would get a new letter in the post
i will see what this letter says b4 i decide if i go for my original offer or not through mcol
try it, give them a call and see what they say
best thing is being polite as they r getting these calls all day and prob get hundreds of people shouting at them all day0
