  • Hi everyone,

    Really just after some advice, i am with the halifax and am having major problems with them. I sent my letter requesting charges or statements of charges with my £10.00 cheque on 24th march, which they say that they have never recieved.

    I telephoned them on 16th april and this is when i was told it hadnt been received but that they send the list of charges to me for free, bearing in mind this is still within the 40 days to respond.

    Anyway on the 10th of may i rang them again as still not recieved the statements or list of charges to be told that no order had been put through on the telephone when i rang them on the 16th april, and the person i spoke to then did it whilst i was on the telephone, so they said that they would order them today. I said no I have requested these twice now and that they are not complying with the data protection act so asked to speak to a manager. This trumped up little man came onto the phone and was rather quite rude, and said that there was no request so he would have to do it now, and that 40days is not correct it is 40 working days, this turned into a little argument as i told him he was incorrect, he said that i need to learn the law about it lol.

    Anyway i have now written to the banking ombudsmen to complain and also the information commissioners office as directed.

    Is this a new stalling tactic? I mean how the hell am i supposed to proceed with my claim when i dont even know how much i am claiming, this has taken 7.5 weeks so far and still ongoing.

    Can anyone offer any advice or is anyone else struggling to get their list of charges?

    Also will the information commissioners give them the kick up the bum they need to get me my list of charges as the small minded manager i spoke to seems to think that they have until the 8th of june to get back to me with my charges list. Arrrrgggghhhh

    Halifax has declined our request to refund bank charges, so going to send them a letter threatening court. Martin says in his letter to send full list of charges again, do I need to do this again?

    Charges are £700 whats the chances of them giving us it, anyone had any declines off Halifax and in the end won?

    If you've got the list of charges "on file", then there is no harm in including another copy.

    If they pay up in full and by return of post, I will be very (although also very pleasantly!) surprised.

    The banks usually cough up at the very last minute before the court hearing, as the last thing they want to have to do is say in court just how much (or how little!) their actual costs are.
    The acquisition of wealth is no longer the driving force in my life. :)

    can anybody help. I have just recived a letter from Halifax saying that they have declined my compliant and are not paying me back any monry they owe me £826 in charges. Does this mean i can't go to court? what dio i do now?

    Hi. I followed Martins instructions, and sent my first letter to the Halifax. Gave them 2 weeks (but secretly allowed a couple of extra days because of the Easter shut-down). The day after the second letter was sent to them I had a response to my first letter telling me that they were so sorry I had a complaint, but their "regulator, the Financial Services Authority, gives 8 weeks to investigate and respond to complaints".

    I have now had a response to my second letter saying that they refer me to their previous letter and are still investigating but I will receive a reply, definitely by the 12 June at the latest.

    The question is, do I wait until the 12 June, or do I do what my letter threatened and now instigate the court claim, as the 14 days were up on Friday????

    My husband says I should wait, but I feel this is just a way of them fobbing me off!!!


    I received the same responses from Halifax when I claimed on 28th February and they responded saying they would deal with it on 4th May, 8 weeks later. I received a letter making an offer of half my claim on 24th April 2007.

    I negotiated with a nice specially employed, negotiator for £1300 of my £1368 claim a few days later, to which they agreed.

    I would say that it is up to you. If you are prepared to pay the court fee and go through the process, you may be in with a chance of receiving more money as the interest and court fee should be included with your claim. If you cannot be bothered with all of that then it is worth waiting for them to deal with it.
  • Yes you can still take it to court, it is a delaying tactic, just go online and start the process, they will listin then,,,,,, trust me I just got £2700.00 back from the Abbey!!!!!!

    What you have described is exactly the response we recieved from the Halifax. Saturday, I finally recieved a reply following the so called "investigation", and this was a standard form letter, produced by a computor and, as far as I am concerned, another stalling tactic.:mad: "We are sorry to advise you.............. perhaps the enclosed leaflet"etc, etc!!!!

    Small Claims Court forms filled in and going in the post today !!!!!!!!!

    need a little advice?

    i have filed a claim with halifax on a closed joint account.

    long story but me and my partner split due to him having an affair and running the joint account into serious money problems and leaving me in debt.

    its only when i heard that i could claim the bank charges back i thought i would give it ago so it would help me out with the mess that he has left me in.

    anyway halifax have said they will refund the money but are sending a cheque. only thing is, there sending it in a joint name cheque.

    any ideas??

    Credit Card Charges refunded £300 plus interest

    Well just an update. After reciveing a letter offering a refund of £195.00 of charges. I rang the halifax to tell them some bad news, that i'd put them in court the on the date that they wrote the letter not knowing they were going to refund me some charges. I explained that i was happy to drop the court case if they were going to refund me my charges plus a charge from an other account totalling £220. I also asked that they pay me the court fee if i couldn't have a refund to which they agreed. So was worth the phone call i hope, :D i went though MCOL does anyone know whether i will be charge the fee if i contact them to drop the case.

    Hello.

    I am new to this forum having lurked for a month or so. I filed my claim for just over £3k a couple of months ago. Usual 8 weeks letter was received and I too was sent a letter of rejection last week (just within 8 week timescale).

    I spoke to their Customer Relations man on number at head of rejection letter today; seemed like a decent bloke who confirmed he was logging my unhappiness and confirmed that rejection letter is ploy to buy more time and hope a few folk don't pursue action. I asked for timescale for offer, however due to overwhelming workload at bank re charges he could not commit. We agreed I will call in a fortnight and court action threat would be carried out if no offer was in the offing.

    I hope (probably naively on my part) that not rushing to threaten court will make the offer from Halifax more generous, although I will not hesitate to carry on with this claim if they offer a meagre sum.
