Be aware all! having sent 3 letters recorded delivery to the Halifax and not 1 being signed for but having replies about them so I know they had arrived I phoned Royal mail who said that the Halifax bulk sign for the mail only Royal mail dont update all the tracking codes for them. Useless when you need to know if something is getting there. Not getting service I paid for really.

Must be the same as me sent the letter on the 1st of May and as of the today the 10th according to the PO website it hasnt been signed for yet so either the mail delivery is slower than we all thought or the bank didnt sign for it as you said

anyway sent my request to the Information Commisioner tonight as I am fed getting messed about
  • Wife wrote for 5 yrs statements (Scotland) - got 2 years with no explanation why. I wrote for mine THREE months ago - two letters so far but no statements.

Reading the posts above it seems quite clear to me that this company are behaving disgracefully, unethically and dishonestly.

Martin, Edinburgh Lass - any chance of dropping a word to your media contacts.

I'm not taking any prisoners anymore, no negociation, full amount plus costs plus interest.

I'm trying to claim back £3,100 (+£1,200 interest) from the Halifax.

I sent the first 2 letters requesting payback and then threatening court action, then i recieved the standard "we got 8 weeks" letter.

I didnt take it any further because at that moment as i couldn't afford the £120 court costs so waited until the 8 weeks were up.

Today (10th may) i recieved a letter off them stating that the charges applied to my account were correct and that i agreed to their terms and conditions when i opened the account !!!!

    SO....WHAT DO I DO NEXT ??

Do i start court proceddings ???...if so do i need to write to the Halifax and tell them.

Hi, Yes start court proceedings as soon as you can afford it. If you are gonna do it vis moneyclaim online its woerth starting your claim now, then you can save it til you can afford to pay. It sometimes can take a while to actually fill in the claim online so its defo worth preparing in advance. Stick to your guns & don't give up cos they will & you'll win. Good luck, SUFC

    RECLAIMING BANK CHARGES FROM HALIFAX

    Hi all,

I'm from Edinburgh and sent my 1st claim letter to my local branch on the 26.03.07. It's now been 45 days and i have heard nothing and they have not cashed my cheque of £10. I phoned them and they said because i closed my account in Aug last year they cannot check, they said i could write to them again if i wanted. I'm sooo confused

Anyone got any ideas!!! Should i write to them again and send another cheque and have to wait ANOTHER 40+ days or should i send a letter of complaint and include my March letter. Should i send another cheque at all?? I just don't know what to do. I'm rubbish at all this letter stuff. (thank you Martin for the templates :T )

    Please help
    Clair :hello:

Hi, mine was a closed account, they cashed my cheque but i didn't receive the statements. I rang the 08457203040 number & was put through to a nice lady who printed a list of my charges off whilst on the phone with me for the last 6 years & i received them 2 days later. They were all listed in a easy to read format so i didn't have to trawl through years of statements. I did get fobbed off at first, they told me i needed to send a cheque, told them i'd done that & they'd cashed it!, then told they'd have to put me through to the closed accounts dept as they couldn't get any info on their screens!!???. Be persistant though. Good luck, SUFC

I wrote to Halifax (HBOS) to reclaim charges with interest (£986 without interest, £1093 with) and they just wrote back (within the 14 days, so at least they've done something right!) saying that the charges 'have been correctly applied' to my account because I agreed to their terms and conditions when I opened the account.

I'm planning to write back and threaten them with court action, dropping the amount to £750 (because apparently this is the maximum that I can claim back in Scottish small claims court) but I can't afford to pay court fees so if I don't get any result from this I'll probably just give up...sad thing is, one look at my bank account will tell them that I have no hope of actually being able to take them to court.

Has anyone else had to take it that far to get a result from HBOS? What happened?

Hi, please don't give up, send the letter threatening them with court action & they should send you an offer, when you get this ring them on the number it gives on the letter & haggle, tell them you want the lot, less the interest or you'll go to court & they'll up the offer or if you're lucky, they'll crack & offer you the full amount. Even if you have to actually start court proceedings, you will win, be patient & DON'T give up. Good luck, SUFC

You could try actually reading the forum, the sequence of events is listed in several places.
Hamsters have no tact and diplomacy, nor do they want any.

Okay, those still waiting on statements, the only answer is to keep on pestering. By all means report to the ICO but they too are so overwhelmed with complaints that they are putting their complaints in batches monthly to the banks.

I would be ringing or calling every day to branch/head office/customer services till they were sick of me.

As regards those claiming in Scotland, start your claim by asking for 6 years not 5 as its only if it reaches court stage that the 5 years kicks in. For those with claims of more than £750/£1500 you can pass your claim to the Financial Ombudsman who will contact the bank if you have been waiting more than 6/8 weeks. If you check the Success Stories thread you'll find one user who got back more than £6,000 from HBOS, 3 weeks after involving the FO.

Please read the Reclaiming in Scotland thread for further advice.

There is no cost to using the FO so if you don't have the money to start your claim via the courts you can also use them.

Hi all, I posted a message on here a few days ago about still not havinga reply from Halifax from my original letter asking for the details of my charges on my account. They said they would get back to me by the end of this week - still nothing! Should I send another letter? If so - what should I say? And do you think I should just go down to my branch tomorrow? Any suggestions would be gratefully received

Stick with the timescales and then send the 2nd letter after 14 days. It's all processed in the main bank charges tread...

    Good Luck
