Hi all, new to the site!!
went into my local halifax branch yesterday to discuss getting statements etc... very helpful young lady ordered them there and then for me(foc). I was also advised that it is not Halifax's policy to close accounts following any claims. thought that might be useful to know.

Halifax have been messing me about and are now over a week past their 40 day limit. So i will today be reporting them to the information commision. HAs anyone done this and whets teh best way to go about it.

Also I heard that every time a bank is reported, they have to pay the information commision 500 pounds to investigate their own complaint. is this true?

    thanks

Having the same problem with the Halifax

Phoned on the 40 days and was fobbed off
sent the 2nd letter giving 7 days to reply and heard nothing
Wife went into branch today to ask and was told they would order them would take 3 weeks and upto 8 weeks to resolve

what now ? should i report to the information commisioner ? whats the best way forward ?

    cheers

    Hello,
This is my first post and i have been helping my wife with the claiming process.
We have gone through the stages of the first 3 letters right up to threatenin court action.
Today we recieved a very patronising letter saying that a full investigation had been carried out and that they were correctly applied.
It goes on to say that we agreed to the terms and conditions and that from time to time they had told us of the level of charges. They say that this formed part of the agreement with the bank and that they have applied them according to the terms agreed.
They also state that the charges mean additional work and they feel that it is reasonable to charge for the service.
They have said that if we are still unhappy then we should go to the ombundsman.
My question is this, we have read that others have got an offer from the bank but we have had just this letter.
Are we still in a position to continue to court and are we still right?
Just feeling a little unsure of ourselves now.
Any advice would be greatly recieved

    Thanks

Requested statements in December, got some but others are still outstanding for my closed current a/c. In Feb. I complained to the F/Ombidsman who then gave the bank 8 weeks to respond to my complaint. Had the usual blah blah "after a full investigaton..." letter off them the other day. I haven't actually sent in a list of all my charges & threatened to take them to court. Can I simply proceed with issuing a claim as they've already refused to refund any charges in the letter? Me head is a spinning!!!

There's no method in their madness, they've sent that letter out to thousands of us. I got bored of waiting for them and have started MCOL proceedings and if you have a look on the success thread you might be tempted too as that seems to stir them into action. Basically, you're still right and keep on at them!

Be aware all! having sent 3 letters recorded delivery to the Halifax and not 1 being signed for but having replies about them so I know they had arrived I phoned Royal mail who said that the Halifax bulk sign for the mail only Royal mail dont update all the tracking codes for them. Useless when you need to know if something is getting there. Not getting service I paid for really.
  • I'm trying to claim back £3,100 (+£1,200 interest) from the Halifax.

I sent the first 2 letters requesting payback and then threatening court action, then i recieved the standard "we got 8 weeks" letter.

I didnt take it any further because at that moment as i couldn't afford the £120 court costs so waited until the 8 weeks were up.

Today (10th may) i recieved a letter off them stating that the charges applied to my account were correct and that i agreed to their terms and conditions when i opened the account !!!!

    SO....WHAT DO I DO NEXT ??

Do i start court proceddings ???...if so do i need to write to the Halifax and tell them.

I too have had the same problem with recorded delivery. When I asked for statements, my letter was signed for no problem ( B of Scotland head office.) However I sent 2 separate letters 1 for personal and 1 for business acc.( 19th April) requesting repayment to Viking Rd. in Rosyth, as advised by the FOS. and there is still no info. on Post Office track & trace. I received acknowledgment of our personal account, but not for the business account. When I called the bank, regarding business acc. I was advised that I had sent it to the wrong place. (rubbish according to the FOS ) and have now sent it to the address in Gorgie Rd, Edinburgh. I used special delivery this time it's a wee bit more expensive, but at least its guaranteed to get there. Due to this, another 2 weeks have been wasted:mad: (However I contacted the FOS regarding this and they have told me they will be treating the claim from the date of the first letter. ie 19th April.)I would agree, recorded delivery is not the service you are paying for and as far as the PO goes, I don't beleive that Bulk signing should be allowed.
