  • Can anyone help me, I'm trying to reclaim charges from the halifax totalling £5296, have started court proceedings as I've had no joy from them, on Martin's site it says the court fees will be between £30&£120 however for my claim it's showing £250 court fees, why the big jump?

    RECLAIMING BANK CHARGES FROM HALIFAX

    Hi all,

I'm from Edinburgh and sent my 1st claim letter to my local branch on the 26.03.07. It's now been 45 days and i have heard nothing and they have not cashed my cheque of £10. I phoned them and they said because i closed my account in Aug last year they cannot check, they said i could write to them again if i wanted. I'm sooo confused

Anyone got any ideas!!! Should i write to them again and send another cheque and have to wait ANOTHER 40+ days or should i send a letter of complaint and include my March letter. Should i send another cheque at all?? I just don't know what to do. I'm rubbish at all this letter stuff. (thank you Martin for the templates :T )

    Please help
    Clair :hello:

I also have a closed account wiv halif*@X, and trying to get the statements has been a nightmare. Don't be fobbed off wiv the line of "we don't keep records of closed accounts" = they have to keep the details going back YEARS!! I certainly wouldn't send them another cheque..try and blag them for free!! Good Luck!

    Hi

This is probably posted on here somewhere but there is so much info to try and find it. I am just starting to reclaim my credit card charges back and i did have a card with Halifax. Just going through my statments now and wondering if you can claim the overlimit fees back as well as the late fees which are £25 in some cases.

Any help would be great thanks :)

Halifax have been messing me about and are now over a week past their 40 day limit. So i will today be reporting them to the information commision. HAs anyone done this and whets teh best way to go about it.

Also I heard that every time a bank is reported, they have to pay the information commision 500 pounds to investigate their own complaint. is this true?

    thanks

I wrote to Halifax (HBOS) to reclaim charges with interest (£986 without interest, £1093 with) and they just wrote back (within the 14 days, so at least they've done something right!) saying that the charges 'have been correctly applied' to my account because I agreed to their terms and conditions when I opened the account.

I'm planning to write back and threaten them with court action, dropping the amount to £750 (because apparently this is the maximum that I can claim back in Scottish small claims court) but I can't afford to pay court fees so if I don't get any result from this I'll probably just give up...sad thing is, one look at my bank account will tell them that I have no hope of actually being able to take them to court.

Has anyone else had to take it that far to get a result from HBOS? What happened?

Just to le everyone know that I have just received £3077.41 from Halifax in after claiming back all charges from them - was offered £2046 however called them and was advised 5 mins later that they would meet the full claim. No court letter issued etc etc and now my account is looking great.

So keep the faith and they will pay out - however without any admission that the charges are unlawful just as a "gesture of goodwill".:T

    Hi Playfire1
My friend has been waiting 73 days for her statements. She phoned the Information Commissioner and they asked her to send them copies of the letters she had sent to Halifax. She contacted the IC at least 2 weeks ago, but she is still waiting. Trouble is she is so skint she can't really afford to phone Halifax or IC. I don't know anything about the £500 charge. I think Halifax's treatment is disgusting as First Direct have offered to pay out 85% of another friends charges only 2 days after asking.
    Please keep me posted.
