    Write "Without Predujice" on the acceptance, its not admissable as future evidence and is not binding. if it ever came to it then.

    "In law, the phrase without prejudice means that a claim, lawsuit, or proceeding has been brought to a temporary end but that no legal rights or privileges have been determined, waived, or lost by the result. For example, if a party brings a lawsuit in small claims court but discovers that the claim is greater than the amount for that court to have jurisdiction, the lawsuit can be dismissed "without prejudice". This means that the dismissal is no bar to bringing a new lawsuit in a court that does have jurisdiction."

    Advising my brother on reclaiming bank charges.
    I believe through the Data Protection its information on you you are asking for, so can ask for charges on two accounts with the same letter.

    He has recieved one set which is a newish account with not many charges.
    However the main one he wants has not arrived. After 40 days he recieved a letter saying it will be a further 3 week. This has now gone and still no statements have arrived.

    What now? Should i go straight to the information commisioner and court or should i advice hime to send another final warning of 7 days saying if they dont comply then i will do the above. If i do this how do i claim under the Data Protection Act???

    mine was acknowledged 24th april 28 days is 22nd may

    had letter saying they will respond no later than 23rd may with was dated the 23rd april the day b4 they acknowledged claim strange eh

    apparentely courts are getting cheesed off with banks not turning up for court so not sending alot of allocation questionnaires so courts are basically look you idiots just pay people the money and stop wasting our time:T

    go into your branch and say your not happy and they have gone over the 40 days therefore you would like them emailed to branch immediately and did this and got them straight away and free of charge

    Sorry to barge in, Have you tried talking to social services, you may be entitled to a crisis loan. I could be wrong, but I am just thinking if you have no money, then it may be quicker to go down this route than citizens advice. If you talk to someone from DSS, they should be able to do something!!! Good Luck!!![/QUOTE]

    I'm feeling a bit better emotionally as I have eaten. I did get a crisis loan
    from DWP. They have had to recall my DLA payment before it reaches the
    bank, so I have to wait for that. I also have a giro dated for next Tuesday,
    so I have next week's money.
    A woman I know slightly, who works at the
    DWP came round with a bag of food! My daughter also helped a lot too.

    I sent the letter of 'first appropriation' only to have them refuse to honour it,
    so had no choice about recalling my DLA. Especially as I have another letter
    for £28 un-authorised overdraft fee + interest.

    Today I received the 'we will not allow your complaint' letter. So, Tuesday
    when I have £10 my DPA letter will be sent. As I have 2 other accounts
    with the Halifax, I'm going for all of them now.

    I got that letter today. Ignore it and carry on! They are trying to make you think you are in the wrong.

    In the letter it says if they don't hear in 8 weeks they will assume you are happy. So get your statements etc.

    My partner requested copies of bank statements from Halifax back in Feb - more than 70 days later we're still waiting!
    We received a letter stating they'd been ordered and would arrive within 10 days.....that was back in March! They provided a phone number to call if they didn't arrive which turns out to be an answering service which probably doesn't even get listened to!
    We were so annoyed, we sent them a letter to complain (by recorded post) and sent a copy off to the Information Commissioner, along with all copy docs and a complaint form. That was well over a week ago.....still nothing!

    Can we just estimate the charges and take them to court? Really don't think they're going to send anything.

    Has anyone else had this problem with Halifax?

    Hi,

    Yes, I am 55 days on from applying for s'ments and even though they cashed the chq on 11th April, Nothing!
    I wrote to the complaints dpt and just had a reply saying they could not find my infor on file as the credit card is now closed. Called them Friday and was told to call back on Tuesday for an update.
    Will giv them til Friday and them send letter to info commissioner and Financial Serv Ombuds.
    They have my money so I want my stamements!
