For Information, I called for my statements and recieved them about two weeks later, after my first letter asking for approx £1000 + interest (gives you bargaining power later) i had the standard reply saying sorry but we have 8 weeks to investigate. I thought about it and came to the conclusion that it was my fault the charges were applied therefore i would go along with their time scale. Just short of the 8 weeks i had an offer of £500. I called in the morning on the number supplied at customer relations and told them i would be acceting this offer as partial payment but would be continuing with the claim for the full amount. He asked if i would negotiate, and i told him i would accept full payment minus the interest. He agreed and i am £1000 better off than i should be. Good luck all.0

of my complaint and are satisfied that the charges have beencorrectly applied to my account.can anyone advise me on my next move,Do i ring them and tell them i dont agree with thier decision and will file court papers or just file court papers without talkin to them any advice would be greatly recieved.ps im claiming 2300 plus interest0 -

I got this letter. I am taking it to the ombudsman as I am in Scotland and claiming over the small claim limit. I would give them their 14 days to change their decision if you haven't already done that and file for court.

This is my first post so be gentle.
After reading MSE and all the advice offered, I decided to have a crack at my bank(Halifax).
1. Contacted Halifax with £10 for 6 years bank statements
2. Received statements within a month
3. Calculated all charges and interest and forwarded letter claiming the lot back
4. After 5 days received a reply stating they were sorry to here I had a complaint but under the financial ombudsman rules they have 8 weeks to resolve individual cases.
5. Pressed on with my time scales issuing threat of court action if not resolved within 14 days.
That is where I am now and Monday the 08/05/07 is the date I should start my online court case with moneyclaim.
I have since read the financial ombudsmans website which shows that they do indeed have 8 weeks to resolve it.
So my question is do I press ahead with the timescales set out within this website or wait until the 8 weeks is up from the date of my initial request for my money back

Same as you I settled for £900 previously asked for (980 - interest inclusive). In all it took six weeks from receiving my statement to settlement and the cash was paid into my account this morning. I didn't have to sign any disclaimer either -- Good luck to the rst of you guys/ladies
No point taking them to court as they will pay up with a wee bit of pressure. Mind you I called several times and at one point was put on hold for 50 minutes. Since I have got free allocated minute on my mobile - it didn't cost me. :beer: :beer: :T0 -

You haven't made a complaint through the Financial Ombudsman though, therefore you don't have to wait the 8 weeks.
Your complaint is based on unlawful behaviour by the Halifax, not customer dissatisfaction. Unlawful behaviour is dealt with by the Courts, not the FO.Hamsters have no tact and diplomacy, nor do they want any.0 -
i had the same letter, i am claiming for 1800 but when the day came to start the court process i didnt have the money so i am just waiting, they say i will hear before the 18th of may.0

Why wait? The bank are just stalling. 18th May will come and go and you'll still be waiting.
The crux of the matter is... don't threaten them with court proceedings then not follow through or prevaricate. That will be perceived by the bank as a sign of weakness and therefore it will get harder for you to get your money.
Stick to the dates you wrote in your letter. If you don't you'll make it harder for yourself.Hamsters have no tact and diplomacy, nor do they want any.0 -

I have got to stage 2 and Halifax have sent me a letter saying they are investigating and hope to have a response within 4 weeks. I intend to ignore this but I am wondering which legal system I should use. My branch is where I used to work in London but I live in Scotland so should I claim in the English or Scottish courts?
Use the English system if at all possible, you can only claim £750-£1500 through the small claims court in scotland, £2000 here in N.Ireland and £5000 (I think) In England and wales. Before you add the stat interest which can take it over this amount.0
