I am in the same situation but just a grimreaper says I am not scared. They will try and settle before court or not turn up so either way I win but will not give up until they pay all plus interest and court fee.
I know this will be the case as no bank will ever turn up in court (unless ordered to) to disclose their exact costs as this will open the flood gates for everyone.

:mad:Just contacted Halifax re claim. I am claiming £6405.00 and live in Scotland.
Thay advised that they sent a letter yesterday stating that they have conducted a full investigation and they will not be refunding the charges and that the charges are lawful blah blah blah!
Is this right? Would it be worthwhile passing it to the ombudsman? and does anyone have any success stories going down this route?
Just to add the above amount is the past 5 years without interest! can I add interest on with the FOS?
Hi, I recieved a reply to my claim from the Halifax today also. It has been sent by the Bank Of Scotland and in it they basicly tell me that their charges are valid and that I will recieve nothing. I originally asked for them to repay £1214.00 (without interest). As this is over the £750 limit for the small claims court in Scotland what should I do now? Will the FOS route work? and can I also add the interest to my claim now that they have refused to accept it? :mad:0 -

There is an option to claim up to £1500 or if you want you can put your claim through the Financial Omubudsman but you won't get any interest putting your claim through the FO as the interest is something that is added to your claim by the courts.0 -

I contacted the FOS when i sent my first letter to halifax on April 1st and they sent a letter backing up my claim to Halifax. I don't think you can reclaim the interest through FOS, however you can claim back 6 years instead of 5, which is the max for Scotland. You should contact the FOS and get advice, however have you contacted your court? When I contacted the court they told me the max was £1500. I think it's called a summary clause??? Not too sure, but once you've gone down the court route the FOS can't get involved!0 -

I haven't had any replies to this yet so I'm re-posting it with a few tweaks.
I have given Halifax longer than I should mainly because at the moment I don't have £250 spare to file my claim.
However a letter arrived yesterday with an offer (a previous letter had said they would deal with my complaint before 3rd May). My claim is for two accounts totalling £5345 and the offer is £3024. I am not going to accept that as a final offer but I have some questions which I would appreciate advice on.
1) If I call to try and get a bigger settlement (I always had in mind that I would settle for £5000 and forego the extra I could make from claiming) and they won't budge any higher than their offer am I obliged to disclose that I am going to pursue the rest of the claim via MCOL. I am concerned that if I do this it will delay the funds they've offered being deposited in my account.
2) I have read other posts which suggest waiting until the money is in the account then writing to the Halilfax to say that you accept the offer as part payment without prejudice but will seek the remainder plus interest through MCOL.
3) How does accepting a part settlement affect a claim. Do I calculate interest on the original figure or on the remainder after the settlement. If it's the latter how do I work the interest out accurately. As far as I can see the only way to do it is a blanket £2321 x 8% instead of working charge by charge.
4) When you claim via MCOL is there the option to include any settlement that may have been accepted.
Your help and advice would be hugely helpful.

I Sent off for my credit card statements which the Halifax sent back to me. I knew that I might of had some charges onto my credit card but did not know how much or when. I then added up all the charges. I only came to £45.00.
I know that it doesn't sound a lot but I thought that I would give them a try and see if they would refund me the money, as I don’t think that £20 to £30 is fair for the amount of work that they have to do to sent a letter. So I sent a letter detailing the charges and the dates, asking to reply within 14 days.
A letter arrived today from the Halifax saying:
Ref xxxxxxxxxxxx
Thank you for your communication regarding the charges applied to me account
I am sure you will appreciate that like other organizations we incur costs for administering your account for late/unpaid payment or over limit situations. The Bank believes it is fair to pass these costs on to the account affected, rather than absorb them into other areas of our organization, penalizing all our other customers as a result.
HBOS clearly outlines our changing policy in the Terms and Conditions that apply to your account. In addition we are committed to complying with the Banking Code, which sets out standards of good banking practice for banks and building societies follow when dealing with personal customers.
After assessing the OFT finding our charges have been reduced as from 1ST August 2006.
The statement is sent as a reminder and the onus is on you, the cardholder to ensure you keep the account according to the agreed Terms and Conditions
In view of the above , I regret I am unable to refund the charges in question as they were applied to your account as per your original agreement.
I trust this clarifies the situation should you require further assistance, please do not hesitate contact our call centre on the above number.
