    I have got to stage 2 and Halifax have sent me a letter saying they are investigating and hope to have a response within 4 weeks. I intend to ignore this but I am wondering which legal system I should use. My branch is where I used to work in London but I live in Scotland so should I claim in the English or Scottish courts?

    Hi I have just recieved details of my bank charges. Do i now send my claim to my local bank or to the address on the letter that my statement of charges came from? Someone please help.

    I'm completely new to this but I found reading peoples stories through the weeks inspirational so I'm going to keep a diary of my activities!

    I sent the 1st letter with 10pounds postal order to my local branch special delivery so it will be with them tomorrow by 1pm. Estimated that they owe me approx 3000 with 700 interest. Currently I have a 500pound overdraft. I've also done the same to Nationwide who I've already closed my account with.

    I was pretty stupid with money as a student but maybe it'll turn out to be positive thing! Hopefully if everything goes well I will be using the money to pay of a chunk of my student debts!! Quite excited!

    I sent mine to my local Branch who then sent it internally to the right department,
    They took my signature away!!!! :confused:

    I have given Halifax longer than I should mainly because at the moment I don't have £250 spare to file my claim.

    However a letter arrived today with an offer (a previous letter had said they would deal with my complaint before 3rd May). My claim is for two accounts totalling £5345 and the offer is £3024. I am not going to accept that as a final offer but I have some questions which I would appreciate advice on.

    1) I am going to call tomorrow to try and get a bigger settlement (I always had in mind that I would settle for £5000 and forego the extra I could make from claiming). I know that I can accept what they've offered and claim for the rest. This makes the claim cost less as the outstanding amount would be £2321 plus interest. If I call and can't agree a settlement will telling them I'm going to claim for the rest delay them depositing the offer in my accounts? If I can't agree I don't want to throw the offer back at them as I need the money in my account as quickly as possible.

    2) How does accepting a part settlement affect a claim. Do I calculate interest on the original figure or on the remainder after the settlement. If it's the latter how do I work the interest out accurately. As far as I can see the only way to do it is a blanket £2321 x 8% instead of working charge by charge.

    3) When you claim via MCOL is there the option to include any settlement that may have been accepted.

    Your help and advice would be hugely grateful.

    I have received today an acknowledgement of service from MCOL re a claim I'm putting in on Halifax they apparently have 28 days to file a defence and they intend to "defend all of the claim" which really worries me what if they win? - has anyone had a letter like this I'm sure someone has what happened are they trying to scare me?

    i couldnt have put it any clearer! its exactly what they're trying to do. you cannot lose, the worst thing is to back down, 100% of claims have been sucessfull so don't worry!
