Ok........I have looked it up (somewhere on the Benefits Thread)
Social Security Administration Act 1992
Miscellaneous
Certain benefit to be inalienable **
187- Subject to the provisions of this Act, every assignment of, or charge on-
(a)benefit as defined in section 122 of the Contributions and Benefits Act;
(b)any income-related benefit; or
(c)child benefit,
and every agreement to assign or charge such benefit shall be void; and, on the bancrupcy of the beneficiary, such benefit shall not pass to any trustee or other person acting on behalf of his creditors.
Thank you so much for that0 -

Hi There I Sent The First Letter To Halifax Claiming £2000 And They Sent Me A Letter Saying Sorry About The Complaint And They Aim To Deal With It Within 8 Weeks. I Waited 3 And Sent The Next Stage Letter Threatening Court Action And They Sent A Letter Back Saying They Had Already Said They Were Gonna Deal With It Within The 8 Weeks That Are Used As Guidlines For A Complaints Procedure. And They Said My Queiry Would Definately Not Be Dealt With Before The 22nd Of May. What Do I Do Next?0

Hi
I am also waiting for my statements from the Halifax (day 47). My chq was cashed 3 weeks ago and I have today written to the complaints department threatening them with the Financial Ombudsman and Information Commissioner if I do not get them within 7 days.
I headed the letter COMPLAINT in bold and I bet a get a reply as any complaint to the Ombudsman will mean a hefty fine for the company involved. I used the same tactic on the TSB last week and today, guess what? the statemenst arrived.

Hi
We've just recieved what appears to be the standard 'sorry to hear your complaint' letter. They say they will give us and update within the next 4 weeks to let us know of their progress. This is in response to letter 2 (or stage 3).
So do we have to wait that time or can we go straight to the next stage?
Any advice welcomed.0 -

you gave them 14 days to comply, and all they do is send a pathetic letter. go straight to the next stage ie LBA. mine went off today, after receiving the same pathetic attempt at politeness from them after 4 days. i waited the 14 days then sent the LBA. go for ithalifax bank claimed £4803 (£5863.88 inc%) paid £6143.29 :j

Hello felllow halifaxers (?)
Sent my statement request letter recorded delivery on the 9th March along with the £10 cheque to cover admin. Halifax cashed the cheque (no surprises there at the lack of goodwill) on the 10th April. By my calculations the 40 days were up 21st April at the latest. So today, with almost a weeks extra grace for them, I ring them up to ask where my statements were and to my astonishment they denied ever receiving my request. Once I pointed out that the letter was sent recorded delivery and the fact they had cashed my cheque I still got the response that their system showed no request ever being made. The best they could do was to make the request there and then for my statements and waive any further charge for the service! I asked to speak to a customer service manager to make a complaint to be told they were too busy with other customers (what does that say). Apparently the staff at Halifax also have no direct contact numbers for the data protection team and couldnt contact them either to ask what was going on.
I have asked for a call back from them with a definite answer as to what is happening but I am not hopeful and to be perfectly honest I am not surprised by this whole episode either. I have had several encounters with Halifax over the years and have been less and less surprised with the excuses they come out with but this time I was gobsmacked and very nearly applauded them down the phone for their sheer audacity!
Anybody else experienced anything similar or does anybody have any advice on how to proceed next? I have completed the complaints form on the Information Commissions website but not sure what to do next; probably just sit and wait for another 40 days before ringing to find out what classic they come out with next time!
Hiya,
I had the same response from halifax the other day when I was chasing up statements that I had requested back in December! I also have the proof that halifax cashed my £10!!! In March I rang the Financial Ombidsmun people and they wrote a 'kick up the bum' type letter to the bank and halifax have until the 10th May to respond...I will keep U posted, regards, Snowberry:rolleyes:0 -
Hi
This is my first post re reclaiming bank charges - I'm only in the very early stages. I've written to both the Halifax and TSB to ask for duplicate bank statements....I sent the letters recorded delivery on April 26th (last Saturday ie 6 days ago). I've been tracking the letters via the Royal Mail website and the TSB received theirs on the Monday but the Halifax haven't had theirs yet?? If they refused delivery would that show up? I'm a bit wary of sending them another letter in case they cash the cheque I sent them - how long would you wait before sending another letter and cheque??
Thanks in advance for any help!!0
