I have sent my claim to court, the halifax have now acknowledged the claim which has now given them the 28 days to put in a defence. Has anyone had expirience of this? What should I do if anything? I would be grateful for any help. They have stopped charging me anything on my bank account since I started the claim, with interest my claim is nearly £7800, which I dont think that they will rush to pay me.

Could someone please tell me the Halifax address that i should send my letter claiming for monies owed?
I only have my local branch address and assume that i would have to send it to a main office somewhere.

I have now not recieved any reply to my second letter. I have spoke to customer services and stated that i would file a claim next tuesday if i had no reply. They have said that i will not get a reply by then. They have 8 weeks so tough!!!. They will regect any claim that i make so do not bother just wait what do you suggest.

Hi All,
My husband is claiming £2000 plus in charges from the Halifax. He sent off for all his statements for the past six years,with the £10 fee,and to be fair,they arrived pretty quickly.
He then totalled the charges (and was very shocked at how much they came to!) and sent off the letter claiming the charges,and setting a fourteen day time limit.
Halifax responded with a letter saying that they had eight weeks,in law,to investigate and enclosing a handy little complaints leaflet (eh?) But they did say that they would try to reply within four weeks.
Today (surprise - the four weeks is up) a letter has arrived saying that they are "sorry you have not yet had a full response to your concerns." (so are we!) but they are "still investigating" and a response will be received "certainly no later than 29th May 2007." (eight weeks from the original letter,wouldn't you know?)
The letter came from the following address:

Now,do we wait until 29th May or do we send the court action letter?

Hello felllow halifaxers (?)
Sent my statement request letter recorded delivery on the 9th March along with the £10 cheque to cover admin. Halifax cashed the cheque (no surprises there at the lack of goodwill) on the 10th April. By my calculations the 40 days were up 21st April at the latest. So today, with almost a weeks extra grace for them, I ring them up to ask where my statements were and to my astonishment they denied ever receiving my request. Once I pointed out that the letter was sent recorded delivery and the fact they had cashed my cheque I still got the response that their system showed no request ever being made. The best they could do was to make the request there and then for my statements and waive any further charge for the service! I asked to speak to a customer service manager to make a complaint to be told they were too busy with other customers (what does that say). Apparently the staff at Halifax also have no direct contact numbers for the data protection team and couldnt contact them either to ask what was going on.
I have asked for a call back from them with a definite answer as to what is happening but I am not hopeful and to be perfectly honest I am not surprised by this whole episode either. I have had several encounters with Halifax over the years and have been less and less surprised with the excuses they come out with but this time I was gobsmacked and very nearly applauded them down the phone for their sheer audacity!
Anybody else experienced anything similar or does anybody have any advice on how to proceed next? I have completed the complaints form on the Information Commissions website but not sure what to do next; probably just sit and wait for another 40 days before ringing to find out what classic they come out with next time!0 -

does anyone have any advice before I call them again this morning
i have exactly the same problem re missing statements,fortunately i noticed and have sent another recorded delivery letter requesting my 2 missing years 2002 to 2004 this was sent 2 weeks ago giving them 7 days to cough up statements as the 40 day period has now expired and only some statements recieved.
can anyone advise how do i chase up my missing statements? i have wrote requesting them but nothing recieved i only have 4 years worth here with a 2 year gap and can`t commence calculations and claim till these are recieved0 -

Just call them and remond them that you gave them 40 days to reply and send you them all and they have failed to do so, you will find that you get them pretty quicklyIf I have been helpful - Hit the Thanks button0
