I've got as far as sending the letter that states they owe me x amount of money and that they have 14 days to reply or I will take them to court.
I wrongly decided to give them more than the 14 days as they must be snowed under with claims. I'm nice like that.
They had sent me the standard ''8 weeks to investigate'' letters and one bank even offered me half of the money I'd claimed for back. I declined.
Now I just keep getting the ''I'm sorry you have a complaint, weeks to investigate'' letters and I'm getting a bit naffed off with it all.
Can I just file my court claim or do I have to send them another letter stating that I'm going to do it first????
Also, If I am to send the above letter, What exactly would I write due to the fact that I didn't go through with it the first time I threatened it and that it has been more than the 14 days???
I know I should have just gone through with it the first time but to be honest I was also a bit scared as well as being nice.

Finally got me £285 back from Halifax this morning as my signature states.

hi m8, just stick to the sequence and time limits YOU give. dont stick to theirs... after reading post after post on here it seems that if you stick to the full (even though boring if you've done many) sequence and it does go as far as court then you will have done it all properly and it wont get kicked out. some people may disagree but if you stick to it, you cant go wrong. cheershalifax bank claimed £4803 (£5863.88 inc%) paid £6143.29 :j

Hello everyone,
I didn't receive my statements after 40 days so I had to send the threatening letter with 7 days. Now they only have until 1 May 07 to send them out which is this Tuesday. A letter went to both my branch and the Trinity Road address.
Anyway, do you believe it? I have 2 years worth of statements. The reason for this was they started charging me in December 2005 and again January 2007 so as I was in the process of complaining to them about the charges from December 2005 I kept everything. They did waiver £60 of the £208 charges from them as a good will gesture (how thoughtful, eh?). I was reading over the correspondence today about this and it states in their last letter (wait overview of the matter: I occurred these charges because my grandmother was very ill and died in the month of December, I knew I needed to transfer money into this account but when I went online it said "Renewed Account" and I could not view any of my transactions so I phoned the Telephone Banking that was the same). Yes, it stated in the letter ...whilst I have noted your comments about the viewing of transactions online, we also provide telephone banking services where transactions can be clarifed.
Clearly they did not read my letter properly as I told them I did use the telephone banking which also did not give me the transactions. What is annoying about this is I have other accounts with them and the balance in the joint account at that time was £1,137.29. I didn't go further with this as I was fed up at this point and thought sod it until they charged me again this year.
In fairness anytime I have asked Halifax to waiver charges completely they have done so except for Dec 05 (£60) waivered and this year only £30 of £148 charge was waivered.
I have worked out how much they owe me from Decembr 2005 which is £266.00 (£283.40 with interest). Seems small amount compared to some but I am in my overdraft of this amount thanks to them.
So do you think I should wait until I get all my statements to see if there is other charges that I have forgotten about or just go ahead with what I definately know?

Hi All,
My husband is claiming £2000 plus in charges from the Halifax. He sent off for all his statements for the past six years,with the £10 fee,and to be fair,they arrived pretty quickly.
He then totalled the charges (and was very shocked at how much they came to!) and sent off the letter claiming the charges,and setting a fourteen day time limit.
Halifax responded with a letter saying that they had eight weeks,in law,to investigate and enclosing a handy little complaints leaflet (eh?) But they did say that they would try to reply within four weeks.
Today (surprise - the four weeks is up) a letter has arrived saying that they are "sorry you have not yet had a full response to your concerns." (so are we!) but they are "still investigating" and a response will be received "certainly no later than 29th May 2007." (eight weeks from the original letter,wouldn't you know?)

Now,do we wait until 29th May or do we send the court action letter?

Tell them thanks for the letter and the offer, I am accepting that as part payment however you will not stop the claim until you receive the full amount, they will pop you on hold and I am sure they will say thats fine. The full amount will be in your account within 14days, Ask for confirmation tooIf I have been helpful - Hit the Thanks button0 -

Just a quickie. If i sent my letter saying that Im not happy to wait 8 weeks for a respose to my complaint and if i dont get a refund in full withing 14 days, how long is it generally before I can expect to hear back from the charming folks @ Halifax?
Iv not asked for the interest but even without this, im claiming over 2200. I figure it will be at least another 1000 in interest as most of the charges are quite old. Im tempted to ring them mid week and say if they pay up my claim within 7 days, i wont take it to court where ill add my interest on, saving them a grand or so.
They signed for my letter on sat so i reckon wednesday will be amply time for someone to have logged it "on the system".
Anyone any advice about time scales or tried a similar ploy?

Can someone tell me what to do now. I sent the 2nd letter and had no reply. I called them saying that I will file a claim against them if I do not receive a reply by Monday and was told go ahead do so and they will just defend the claim. especially as they have said that they have 8 weeks to look into the claim.
I keep hearing about LBA what it this.0
