    Hi all

    My 40 days since sending the letter was up today and still no statements or any reply from the Halifax

    sent the letter on the 21st of March and they cashed the cheque on the 13th April

    Phoned today and was told that the 40 days starts from when the cheque was cashed is this true ?

    Told them they have 7 days or a complaint would be going to the information commissioner

    Is this the right way to do it ?

    Surely the date of cashing is not right as they could just sit on the cheque for months

  • Hi all first time on here so not sure if its already been posted but i am claiming £2766 been through all the stages and they tried to fob me off with the 8 weeks letter but i stuck to my guns they have not replied so i'm onto issuing court action. This is a scary thing coz at the end of the day i don't want to lose and be liable for court charges so i want to know if anyone has taken halifax to court and what has happened? Did you win? Or did they settle before it went to court? Knowing my luck i'll be the first person to lose!! Please give me your thoughts xxxx:confused:

    Dear all,

    New to the site and have seen some get stuff. I have sent my intial letter in to Halifax asking for my charges. 40 days have elasped and have heard nothing. I called them today and was notified that they had a back log and were not able to give me any idea for when a response can be issued. I am sure many have and are still facing the same situation. Is there anything i can do? :confused:

    Also I have loan with a bank which charges me £ 25.00 for late payment. Can I claim a proportion of the charges back as above. :rolleyes:

    If they didn't try to rip people off so much then they wouldn't have a "backlog" would they.

    This 40 day rule is a rule, they never gave me any lattitude when i asked them for compassion. No, they just kept on penalising me until i was nearly cracking up over the stress, i also suffered almost starving because of their constant charges for failed DD's that were being caused because they couldn't bother to hold the charges until things stabilised.

    No compassion what so ever, therefore if they ask me for extra time after the 40 days, they can forget it, they caused the problems they are getting!

    In the same boat!!! Contacted them 2 weeks after the letter saying they have 8 weeks, and they said it hadn't been looked at even as they had 8 weeks! Went on to MCOL and the claim was issued on the 20th April. Hope it doesn't go all the way!!

  • hi i`m waitting for halifax to give me back my money £1440!!!
    I have phoned a couple of time keep getting told diffrent every time!
    one perspn told me i would heard by today! someone else said they are dealing with letter recived end of march (that was 2 weeks ago) today i`m told im in a queue and im somewhere in the middle!!!

    I have given them to 5th May before a start court (but dont really have money to start)
    My first letter has charges from March 2001. As halifax are taking so long will they take them off as it is now passed the 6 years!!
    hope this makes sense??!!

    Small claims court is free for claims under £5000 matey.:cool:

    We aren't supposed to offer advice, this isn't advice, this is the role of the small claims court and i am just relaying the fact.


    I believe you can start county court action without paying anything.

    As in the past few posts though, they are worried about losing the case, unlikely, but that is the only time you'd have to pay costs in the small claims court.

    You can find your local county court doing an online search, they all have references to location, online.

    Hope that isn't construed as advice.

    Deltas info is wrong

    There is a fee for taking bank thru small claims and it depends how much you are claiming for.

    Fees are btween 30 and 120 as i have been informed

    I paid 120 as im claiming over 4000

    As for banks not going to court this is true in the majority of cases and you would be very unlucky at the moment to end up in court

    Banks are making courts cheesed off at mo with banks not turning up to court so in theory wasting time

    If i was you put an mcol in against the bank if you have sent the letter in step 4 stating you are going to start court proceedings in 14 days if you do not hear a satisfactory response of them

    Remember to include your interest and court fees in your claim

    and good luck but remember you will have to pay a fee not like delta said and it would be free under claims of 5000!

    you will find that your initial time claiming it will say northampton county court dont worry as this is normal as and when it gets nearer to court date etc it will change to your local court

    you can claim late payment fees

    and go to local branch tell them you have waited longer than 40 days therefore gone past your timescale

    get them to ring head office/customer relations and tell them to fax or email your charges now please, it worked for me and got them to branch within 5 minutes
