I keep hearing about LBA what it this.
Hi, just stick to the procedures & timescales it states on this website & you will reap the rewards, ignore all the banks negative letters & stick with it. Don't phone them about anything accept when you get their offer letter. If you need to just write to them & send everything recorded delivery, don't bother yourself ringing them to discuss your case, its a waste of your time. Good Luck.0 -
Letter sent on 23rd requesting charges be repaid , Letter recived this morning saying "if we are unable to respond to your concerns within the next weeks we will write to update you of our progress"
Then it states:
If you have employed somebody to handle your complaint please note the following:
Halifax does not charge you to investigate your complaint.
Halifax will not be liable for any costs incurred if you decide to employ a third party to handle your complaint during this review.
Halifax in general will only make payments directly to account holders.
You may wish to check if the third party you are using is authorised under the Claims management Reulation.
Then it ends with enclosed is a copy of our leaflet which details how we handle complaints , I hope we can work toghter and find a solution that you are happy with.
This sounds quite promising and it has also surprised me that the bank charges that were due to go out today have not been taken...
I am claiming charges from 2000-2004 total amounts for both accounts is £1400 , These were charges incured while my husband was ill, he has since died and until last week have never had any charges since.0 -
Evening Folks,
Just a quickie. If i sent my letter saying that Im not happy to wait 8 weeks for a respose to my complaint and if i dont get a refund in full withing 14 days, how long is it generally before I can expect to hear back from the charming folks @ Halifax?
Iv not asked for the interest but even without this, im claiming over 2200. I figure it will be at least another 1000 in interest as most of the charges are quite old. Im tempted to ring them mid week and say if they pay up my claim within 7 days, i wont take it to court where ill add my interest on, saving them a grand or so.
They signed for my letter on sat so i reckon wednesday will be amply time for someone to have logged it "on the system".
Anyone any advice about time scales or tried a similar ploy?
Thanks in advance
i would have thought you ll be putting in court proceedings after 14 days are up to be honest,
its happened to me and i filed court proceedings on the 17th april 2007 and was issued on the 22 nd april they acknowledged 24th
dont bother ringing them its a waste of time i was told my 14 day letter was put to the side as they had 8 weeks
basically p@#$ off you gonna have to fight for your money
stick to timescales when 14 days is up file court proccedings against them using mcol
add interest on to charges mine worked out about 900 quid
when you file it will be charges plus interest plus court fees!!!!!
so in theory before you file you ll usually only get charges back
when you ve filed your entitled to interest and court fees on top
dont be scared go for it0 -

this is a stalling tactic from halifax you ll need to send the step 4 letter it states your not happy and that if you dont receive a satisfactory response in 14 days you ll commence court proceeding thats what i would do and have
add your interest up ready for filing mcol this will be added to your claim!!
dont be frightened the letter you received is the standard letter sent out from halifax your making the claim not them, they work to your timescales not theirs and thats what they are trying to do.DOnt sit back and wait post step 4 letter by recorded delivery and hand one into local branch
ps sorry to hear about your husband my dad passed away not so long ago totally out of the blue leaving my mum alone
Keep your chin up
regards and best wishes for the future

Thanks
write down the full amount in front of you then ring them the amount you want is the amount in front of you!!!
say thanks for the offer but i will accept this as part payment but will still claiming for the rest as im not prepared to settle for 500 pounds but you are willing to finish claim process if i receive ....say xxxx the amount in front of you
you have to haggle with them and be nice and not offensive to them it ll get you nowhere
they are trying to get away with not paying full amount
some people would accept 500 and thats what halifax want.... to pay less!!!!!
so ring them be nice and let me know how you get on0 -
Hi.
I've been a member of Halifax since my late teens, over 20 years.
Over the past few years they have charged me for failed dierect debits and on several occasions they were taking money out of my account which made futrther DD's fail, two occasions when i was injured from work, they took nearly every penny i had spare for living for weeks on end and i ended up starving and nearly destitute and all that dispite my apprising them of the situation and asking for some compassion. They were hard nosed and didn't give a damn. I nearly packed in my job because it was so crippling.
Also when my father died and i was hit hard by it, one DD failed which led to another and another so on.
All in all they owe me about £1900 over the past 5 years. (2/3 of that by them taking money which led to a next one failing in the same week and a next one and so on, snowballing.)
Shortly after my father died i injured my wrist badly and had to go onto benefits and ealier this year they even took £35 of my benefit which is over %50 of what i get for a week, this was because UK Online asked for £9.99 early and the money wasn't in my account.
I mean it is obvious if somebody is getting £51 benefit, that taking £35 off them they are going to suffer badly and my benefits go into my account.
I now only have UK Online as a direct debit because i cannot afford to miss payments.
What i am worried about is losing the account i have had over half my life now, it is the only thing that has stood the test of time and i haven't got the money now to open another account with another bank or building society.
Does anybody know if the Halifax are still closing accounts of their clients who are claiming back illegal charges?
I want to claim against them but also need an account.
Dispite everything i happen to have a good credit rating and also wondered if having a bank account closed by a bank affects ones credit rating.
Any feedback as to the Halifax tactics regards closing accounts welcomed.
Thanx!Pax-Delta-Pan.
Enlightened evolution.
Tempered from the chaotic forge of life.

They did the same thing to me offering me 689 half of what I was requesting. I realised that if I submitted a claim to court at £120 I would received the full amount plus interest on that full amount. If accepting what they offered and I had to pursue the other half in court then I would only get half the interest and costs.
I said a prayer, rang them up spoke the the bloke they employed to negotiate, told him I had already checked the court charges was prepared to pay it and if they did not give me what I wanted it would cost them another extra £400 as I am not afraid to go to court, I stuck to my guns and got the full amount I wanted which was less £68.0 -
Hey,
I reciveved Halifax's 8 week to investigate letter over two weeks ago.
I issued a further letter indicating that i will start court proceddings if my claim was not resolved within 2 weeks.
The 2 weeks for the Halifax is up tomorrow and lo and behold, i get a letter today telling me that they are still investigating and i should have a response no later that 30th May 2007.
I intend to ignore this and continue with my threat to issue court proceedings tomorrow.
Is this the best way forward. Any advice would be appreciated.0
