Not at this stage no, If however i do have to take legal action ill add it on then. to be honest, i could do with quick settlement so leaving this of as a bartering tool. If they settle quickly, i wont claim interest. if not, ill whack it all on there.
it would probably take as long for them to reply as it would for you to go thru mcol to be honest but the decision is up to you
good luck:A0 -
Hello,
I received the standard offer letter from Halifax. But it was vaguely worded stating that this ends my complaint against bank charges. This I interpreted as meaning any future charges I could not ask for return.
So I refused to sign it and sent them a letter that they had 14 days to return the money and only the money would keep us from court.
Did I do the right thing? I'm not a lawyer but the wording was such that it was like a waiver. I'm sure many of you know which offer letter I mean.
They've only a couple of days left...I would rather not phone as I'm not very good on phone calls.

I have going into the bank each week. I'll have no money to live on,
an un-authorised overdraft, charges for not haviing money to
cover their charges and more charges if I don't cancel a small
direct debit due next week. They may as well make me bankrupt.
He was about to reverse the charges when he spotted a notice on my
account saying I was not to be issued with any refunds. (I have had
a refund when they made a payment early).
It ended up with him offering to send me an application for a list of all my
charges in the last 6 years. He warned me though, there is a big backlog!
I wont wait for that form though. I'll send a letter, as soon as I can borrow £10.
I didn't even get 7 days notice of charges so had no chance to cancel my bacs, so my
income support will be taken by the Halifax.
To say I'm feeling pretty desperate is an understatement.
The Social Security Act (I think Section 187) makes it clear that it is unlawful for a charge to be levied against ur income support. Therefore phone the bank and explain that you are reporting them to DWP, and actually do it, they will investigate.
Ok........I have looked it up (somewhere on the Benefits Thread)
Social Security Administration Act 1992
Miscellaneous
Certain benefit to be inalienable **
187- Subject to the provisions of this Act, every assignment of, or charge on-
(a)benefit as defined in section 122 of the Contributions and Benefits Act;
(b)any income-related benefit; or
(c)child benefit,
and every agreement to assign or charge such benefit shall be void; and, on the bancrupcy of the beneficiary, such benefit shall not pass to any trustee or other person acting on behalf of his creditors.0 -
Hi everyone,
I've filed a claim with the small claims court for the total amount of £1620.00, and this morning I have received a 'Notice That Acknowledgment of Service Has Been Filed' from the courts. On the second page of the letter the Head of Legal Services has ticked that they intend to defend all of this claim. Could someone please help me as I really have no idea what to do now and am kind of crapping it now.
Thanks gray
P.s.
As you can probably tell this is my first ever claim0 -
I wonder if anyone can help?
I ordered statements from Halifax on the 1st Feb and received them on the 13th Mar and sent a letter the next day asking for my bank charges back, whilst waiting I decided to go through my statements again and noticed 10 months of transactions missing????? I didn’t notice this at first as the each statement was numbered and I appeared to have them all starting from 1 to 85 it’s in the middle of statement 12 there is a jump from Dec 03 to Oct 04. I called to find what was going on and was told they would look into it and call me back. In the meantime I have sent them another letter with a further 14 days before I start court action, this deadline has passed and I’m about to start claiming through MCOL. I’ve spoken to Halifax several times in the last 10 days to find out why 10 months worth of transactions went missing from my statements, which they couldn’t answer, but said they would get me the missing statements ASAP. Calling them today I have been told that they have up to 40 days to get statements and since these statements were only order within the last 10 days I would have to wait. Is this right? I originally ordered my statements on the 1st of Feb and it’s not my fault that they somehow messed it up?
As the deadline has passed I’m going to start court action but have a couple of questions
1) Can I claim now and then make another claim once I get the missing transactions?
2) On the MCOL website there’s an option to choose “yes or no” regarding human rights (just above the option to charge interest) what’s this?
3) Is there anyone I can complain to regarding the way Halifax has dealt with my request for statements and that the fact It was missing 10 months transactions?
thanks for anyhelp
hi guys,
