no problem you will get a notice of issue thru post shortly and it will say that it will deemed to be served from...........
thats the date you count from, soon as it gets to midnight of the 14th day click judgement ( it wont let you do it if its before 14 days )
Good Luck and dont be scared if they acknowledge if they do count 28 days from date served as they get an extra 14 days

Just a quick post to say thank you very much for everyone that helped me claim my money back from Halifax including you Martin.
I started the claim in Jan 07 and today received a letter from the Halifax offering £274 half the money that I was claiming £548 in total.
I called customer relations stating that I was not happy with the offer and unless full payment was offered today I will be filing a claim. He spoke to his supervisor and 5 seconds later come back to the phone and said that full payment of £548 will be settled within 14 days.
Now just waiting on the OH's claim. Thank you so much on again.:D

advice pls. my son has 2 accounts with HALIFAX 1 open 1 closed and i told him to aply for bank charges incurred whilst he wasnt working. He applied for £1700 and they offered him £980 on the grounds it was final payment for both accounts which he accepted 2 weeks ago.He has now phoned me to say they have put £250 into his open account and the rest into the closed account. the question is How do you get money out of a closed account. anyone know??0

A quick call to customer relations/service will solve this problem. As long as his closed account was not id debit. If it was closed at a nil balance they will issue a cheque

could someone give me some advice with regards to when the six years charges start from??????????
the halifax rang me today to settle my court claim against them, they told me they will deduct £200 in charges from my claim because the six years starts from the time you issue your court claim to them, and not from wen you first applied for them to be paid back,!! i requested them bk in jan 07}and
as i issused mine on the 28th march 07 i can only claim 6yrs bk to march 01, as anyone else heard of this????????? i told them its all crap and im not exceptin it they either pay what ive asked or my claim will go all the way!!!!!!!!! said they will ring me tomorrow wen they"ve looked in to it
if anyones had this prob would like to hear from you

Aw hole £62 of charges but hey every penny counts and will make a dent on the very last bit of our debt

They are digging in and saying it will take 8 weeks to deal with my complaint. Is this right? or do I stick to my time line of 14 days as they have stated in there letter they have 8 weeks to deal with this query.
I'm unsure what to do. Has anyone out there come across this with Halifax and if so how did you proceed?
I'm also having delay tatics with the Halifax credit card.
I would be very grateful any advice as they have treated me pretty badly in the past.

I ordered statements from Halifax on the 1st Feb and received them on the 13th Mar and sent a letter the next day asking for my bank charges back, whilst waiting I decided to go through my statements again and noticed 10 months of transactions missing????? I didn’t notice this at first as the each statement was numbered and I appeared to have them all starting from 1 to 85 it’s in the middle of statement 12 there is a jump from Dec 03 to Oct 04. I called to find what was going on and was told they would look into it and call me back. In the meantime I have sent them another letter with a further 14 days before I start court action, this deadline has passed and I’m about to start claiming through MCOL. I’ve spoken to Halifax several times in the last 10 days to find out why 10 months worth of transactions went missing from my statements, which they couldn’t answer, but said they would get me the missing statements ASAP. Calling them today I have been told that they have up to 40 days to get statements and since these statements were only order within the last 10 days I would have to wait. Is this right? I originally ordered my statements on the 1st of Feb and it’s not my fault that they somehow messed it up?
As the deadline has passed I’m going to start court action but have a couple of questions
1) Can I claim now and then make another claim once I get the missing transactions?
2) On the MCOL website there’s an option to choose “yes or no” regarding human rights (just above the option to charge interest) what’s this?
3) Is there anyone I can complain to regarding the way Halifax has dealt with my request for statements and that the fact It was missing 10 months transactions?

Hello all,
I have been reading this thread for weeks now, and have followed Martin's advice, the Halifax have had plenty of time to pay up, but despite numerous letters / phone call they are still stalling.
Here the story so far:
15th March - Sent request for statements to local branch, I actually handed them in over the counter, with a cheque for £10 enclosed.
20th March - 31 crisp white envelopes landed on the door-mat containing 6 years worth of statements, they have still yet to cash the cheque.
20th March - Sent 1st letter requesting repayment of £4163.00 in charges, (couldn't believe it was that much!), I also made a note of the interest at 8% on this letter and enclosed a schedule of the charges from the calculator, I also handed this in at my local branch.
30th March - Received the standard 8 weeks to reply letter from customer relations.
3rd Arpil - Sent 2nd letter requesting the repayment to my local branch, recorded delivery, giving them 14 days to reply satisfactorily or I would commence court proceedings. This was signed for the following day.
17th April - Telephoned customer relations on the phone, spoke to a relatively helpfull lady, told me a letter was due to be posted in a few days. (I was feeling hopefull!!)
19th April - Received the standard letter; we are still dealing with your claim, we will respond by 21st May. (LOL)
26th April - Again Telephoned customer relations, giving them one final option to pay, or go to court.

I intend to file online with MCOL, but I have 3 questions;
1. - My Claim including interest at 8% comes to a little over £5000, what figures do I use on the claim form, if it goes over £5000 they want more to start the claim?
2. - I also have given serious consideration to claiming 16.9% compound interest; I mean, I have been in the overdraft for the entire 6 years, give or take a week, so they have been charging me 16.9% on it, sometimes 29.8%!!
I suppose it's the same question, does the claim include the interest at the beginning, meaning I have to pay the higher fee, or is it added afterwards?
3. - We, my wife and I, are currently on a low income, my wife is on Ordinary Maternity leave, so receives no weekly money, I have a declared income of about £150 per week, we get Child Tax Credit and Council Tax Benefit. We have no savings in particular. Are we entitled to exemption of the court fees, we would really struggle to pay the £120 let alone the £250?
All your help has been brilliant, we wouldn't have got this far without this site, but I could really do with a bit of help more pertinent to my own circumstances.
