    What I will do is cc this letter to my local branch as I did not send them the first one to begin with. I'm going to send them out today. I receive all correspondence from Halifax online but still have not received anything.
    Barclaycard: £4,217.55/£5 = 0.11% | Tesco £3,810.55/£3,770.55 = 1.05%
    Total: £8,027.80/£5 = 100%/0.06%
    Mortgage £99,692/£51,652.33 51.8%
    Car Loan: £9,217.20/7,527.38 81.67%

  • Ok, I have done up the second letter requesting the charges within the next 7 days and along with it I have attached the original first letter and a photocopy of the recorded delivery receipt. At the bottom of the letter I have note that it has been cc'd to my branch and also a copy of my file. So all of this is also ready to be posted to my branch as well.

    I'm off to the post office to send both letter and attachments recorded delivery. If I don't receive anything within the next 7 days then I will make a phone call telling them they are in breach of the DPA and that I am complaint to the Information Commissioner.

    your like me and i guess your on paper free banking service, you will find they send everything by post as with regards to claiming charges and wont email letters thru your online service.

    Also seems to be even more a liberty taking 39 pounds per charge when all you receive is an automated email which would cost even less!!!!!!!

    I received the standard 8 weeks letter off Halifax a couple of weeks ago

    I decided this wasnt good enough and sent the not satisfied with response and will be commencing court proceedings letter in 14 days

    I filled in the mcol form on 17th April 2007, served to Halifax on 22nd April 2007

    Claim acknowledged on 24th April 2007 by Halifax, gives them 28 days from 24th April 2007 to sort defence, due date 20th May 2007

    Then....

    Received letter today dated 23rd April as with regards to previous complaint ( ie 8 weeks to investigate letter ) they are looking into complaint and will be trying to sort for 23rd May 2007

    Now what a coincidence that my claim was filed 22nd, they sent a letter 23rd then acknowledged 24th????

    Is Halifax being crafty and possibly trying to get a partial offer in before 20th may 2007????

    This may have affect on court proceedings what do people think

    I wont be accepting partial offer ill let it go to the very end cos aint moving!!!!

    Bring it on Halifax ur messing with the reaper :eek:

    I have just started the process with Halifax and got the same 8 week letter a couple of days ago...........how long did you wait until you sent the not satisfied letter and did you mention in it about the 8 weeks??

    Does anyone know if this 8 weeks is actually legal or just a bluff as it says in letter that regulators give them this time.

    Also anyone who has not received charges/statements same happened to me and I phoned them and they were with me two days later.......didnt even want to charge.

    I've also heard that you can claim charges back for Mortgage charges.......is this correct and is it the same process?? What charges can you claim for??

    I sent my not satisfied letter blah blah 14 days the day after!!!!

    i didnt waste any time get the letter sent straight away, they do have 8 weeks thru the fsa but this is used as a stalling tactic to make you panic and worry, also if theres any significant cases going to court ie barrister taking natwest case, to see if judge rules in the banks favour or waiting for the OFT and see if they change what banks can charge ( which is happening and in the process ) as for mortgages search other threads you ll find it there or post new thread asking edinburghlass 's help shes really good with this site and very helpful:T

    Last week i sent off my first letter stating that their charges were unlawful and that i wanted the full £6410.88p from them and that have 14 days to respond.

    Today i recieved a letter saying how sorry they are that i'm unhappy and that they had 4 weeks to respond, i'd have been a lot happier if they hadn't stolen all my money but lets save that for another day.

    Anyway, my reason for posting is this.

    Should i send them the 3rd letter next week threatening to take them to court and giving them another 14 days to respond in a satisfactory manner or forget letter 3 and just go to the next stage and start court proceedings seeing as we all know thats where i'm going to end up anyway.

    I'm simply looking to save time in the long run. Any advice would be gratefully recieved as i'm happy to take either route but given the choice then i'd like just to go straight to the court stage.

    What do you think?

    Follow the tried and tested route, you are contemplating taking a large company to court without giving them notice, not a good idea.

    No need to wait 4/8 weeks but do follow the time scale as laid out in Martin's article.

    dont jump steps use the template letter in step 4 saying your not happy with response and youll start court proceedings in in 14 days if a satifactory response isnt acheived by bank.

    if after 14 days the bank has not provided u with action your happy with go to mcol step ( step 5 )

    being patient and follow claiming step by step im in the same situation like many others ive just filed mcol against halifax for 4200 after not hearing anything for the 14 day period

  • i have had my claim sorted today claimed £1396 i got £1396 ,they did say 8 weeks blah blah blah i used my timescale but mucked up on mcol then recieved an offer today about 6 weeks after the 8 week letter rang them up didnt know what to say except im not happy they gave me thefull amount
    they say the 8 weeks which may be a delaying tactic but everyone i know who has waited has had they money refunded within the 8 weeks but i say press on with your timescale
