I have received a letter today from halifax.
We were offered £267 a few weeks ago as settlement which we have written back and turned down.
The letter today says that they are sorry that we don't want to accept and that they have tried to call us (joint account) to discuss the matter further. They want us to call them.....
Our last letter states that we want to get the full amount and that we want to claim it with interest - if we haven't heard in 14 days we will go to court.....
Has anyone else had this, if so, what are they likely to say?

thanks for that, I think I will leave it till the weekend, if I havent heard anything I will send another letter to the Head Office and hope that works. I bank online and have been checking that daily but nothing been received.

im claiming £2913 inc interest and court costs. I have to say they were very good about how quickly my statements arrived and they didnt charge me the £10.

TIMINGS ON MCOL
Once you file your claim, you will see this:
Status: Requested
Your claim has been submitted to the court for final validation before being issued.
Then, usually a day later, it reverts to this:
Status: Issued
Your claim request has been accepted. The Defendant has 14 days from the date they are served with the claim, to reply. The court will send you a “Notice of Issue”.
The court allows five days for the claim to be deemed served, even if the bank acknowledges before the five days are over. If the bank does not reply within the 14 days after the claim was deemed served, you can enter judgment by default.
Status: Acknowledged
If the bank acknowledges at any time within those 14 days, they now have 28 days from the date of service of the claim form to file a defence. The court will send you a “Notice that Acknowledgement of Service has been filed”. If the bank don’t defend, you can enter judgment by default after the 28 days are up. If that date falls on a weekend, the court allows one or two extra days for them to respond. You will know if you are too early, as the system will simply not allow you to enter any judgment before the time is up.
Status: Defence
If the bank defends before the 28 days are up, you cannot enter judgment or do anything else online anymore. The court will send you a “Notice of Defence”.
If the bank is just biding time before they send you a cheque (and have told you so in a letter already), you might be sent a “Notice of Defence that Amount Claimed Has Been Paid”. You have to tick the box whether you wish to proceed with the claim or not. Wait until you have the money in your account, then send the form back. You are given a month to do so.
If the bank defends with the purpose to go to court, you will be sent an Allocation Questionnaire which you have to fill in and send back to the court. A court date will then be set which you are required to attend. The bank will either settle with you in any way before the court date, or they will not turn up on the day and you will win by default.
This is how it usually happens. Alterations from the norm are possible of course.0 -

you will find that halifax do not send email letters regarding claim progress its all done snail mail to doorstep
they only post the letters not email them0 -

i would ring them first and say your intentions is still to proceed with above letter of court proceedings but are willing to come to some sort of amicable amount
i would stick to your full amount not inc interest ( try interest first it might work ) but you may have more joy asking for full amount without interest as most banks that i can see will only pay interest if courts proceedings have started.Some cases people do get the interest as well!!!! without start court action
So give them a ring and write the figure down your after and fight for that figure nicely by saying your not happy with amount offered but you are willing to settle for xxxxx amount. Haggle and barter your way to the figure you want, youve already mentioned court so they may settle to prevent this and pay more i.e. court fees and interest.

Just a quick post to say thank you very much for everyone that helped me claim my money back from Halifax including you Martin.
I started the claim in Jan 07 and today received a letter from the Halifax offering £274 half the money that I was claiming £548 in total.
I called customer relations stating that I was not happy with the offer and unless full payment was offered today I will be filing a claim. He spoke to his supervisor and 5 seconds later come back to the phone and said that full payment of £548 will be settled within 14 days.
Now just waiting on the OH's claim. Thank you so much on again.:D£68 in £2 coins0
