no carry on claiming its total rubbish just cos your on benefits dont mean you cant claim that would be discriminating. If you go to court process with claim i think it doesnt cost you a penny at court or even massive reduction in costs to claim thru court.

So if thats the case why do courts allow reductions in court fees for people on benefits???????

In other words it means you can claim as courts have put measures in for people on benefits

i would carry on and good luck

and banks can do what they like they ll still charge you for missed payments etc

You are misunderstanding what I am saying...... I wonder if it is true, that if the only income into one's bank account is from Income Support etc, the banks are NOT allowed to charge bank charges.
  • I phoned Halifax to ask for my 6yrs worth of statements. I was told that it was £5 for the 1st five statements AND £5 per satement after that!!! They wanted £300+ just for the statements????????
So, thinking that the charges alone were what Martin was referring to in the avise I wrote to Halifax, enclosing a cheque for the advised £10, asking for details of all charges for the six year period.
It has been about three weeks and now I have received a letter. It states:

"Thankyou for letter requesting specific information for the above account. Please find enclosed Statements for the dates specified.

If you requested information relating to manual intervention on your account, I regret that HBOS plcis under no statutory obligation to record this information and therefore, I am unable to assist further with your request."

Where has this come from? I understood this to be a part of the Data Protection act and I have paid £10 for simple statements showing only opening and closing balances on my account!!

    How do I defend this?

    Thanks for you time.

    Jay.

I got the same letter when I requested statements, I got that letter one week and two week later I got a nice big envelope full of bank statements. I would not worry about it, you will still get the information you require

    Hi all

Have read through loads of posts and am a little unsure.

I have just won by default on my bank charges from the halifax bank account (£820) and am now in the process of claiming back £1278 on my Halifax Credit card.

The only address i have for them is in Scotland. can i Still start court action on a Scotish Address??? I know some posts have said the laws are different in scotland.

Thanks all for your help and encouragement

  • Hi everyone,

I have a few questions. I am currently waiting for my list of bank charges from Halifax and today is the last day and have received nothing. They have already cashed my £10 cheque.

    1. Is the 40 days working days or ordinary days.
    2. I'm from Northern Ireland do any rules differ?
    3. I am also in the process of looking into remortgaging and I am afraid that it will be Halifax that will have a better deal. Will this effect anything if I was to sign up to Halifax with their deals?

    Thanks everyone.
    Barclaycard: £4,217.55/£5 = 0.11% | Tesco £3,810.55/£3,770.55 = 1.05%

Just received my statements from the Halifax today for 1 of my accounts although i had requested for both accounts, they assure me that i should receive the 2nd accounts statements by tomorrow. I have been impressed so far as this only took exactly 7 days from statement request!!!

Have a couple of questions before i send my letter, i know i can back date 6 years but would that be from jan 2001 or from 24th April 2001? also advise says to send dates and charges within the template letter, can i just write the charge and date on a piece of paper or do i have to photocopy statements?

I know this may sound a bit of a dense question but i am blonde and from Essex and we do easily get confused!!

    Thank you all for support

Write the SAR again enclosing proof of receipt. Before I advise on how that may be presented, what proof do you have ?
